What are my rights if I have injuries as a result of a car accident ? If you have suffered an injury in an accident and you are either the driver or a passenger in a vehicle, a pedestrian, a cyclist or the driver of another vehicle, you will be entitled to Accident Benefits regardless of whether or not you were at fault in the accident. If you were not at fault in the accident, in addition to Accident Benefits, you may have the right to sue the at-fault driver (covered by his or her insurance company) for pain and suffering, and other out of pocket expenses and lost income. In particular, you are entitled to make a claim against the at-fault driver for injuries that result in a permanent and serious disfigurement or permanent serious impairment of an important physical, mental or psychological function, as well as any income losses.
