What is “historical sexual assault” ? An historical sexual assault is an assault that may have occurred many years (or decades) ago, but where the victim of the abuse has only recently remembered, come to terms with, or gained the strength to confront the facts surrounding the assault. The Limitations Act in Ontario recognizes that there are many significant factors that may prevent a person from coming forward at the time the assault is committed, so there are circumstances where these cases can proceed despite the passage of a limitation period.
