Accident and injury prevention Halloween night.
Posted by Ottawa Personal Injury Lawyer, Ottawa Accident Lawyer, David Hollingsworth in safety on October 28th, 2009
Ottawa personal injury and accident lawyer David Hollingsworth: Be careful out there this Saturday night. We need to keep our children safe and free from injury. The Ottawa police have put out these safety tips and I thought I’d share them with you.
The night is quickly approaching when the streets will be filled with ghosts and goblins, not to mention princesses and fairies. As always, there are a few important Halloween safety guidelines that should be observed to ensure the night runs smoothly.
Around the house… Many people enjoy transforming their homes into eerie scenes. Be sure to keep the path leading up to your door free of obstacles for the little ones, especially those with masks who might have trouble seeing in dim light.
Keep pets indoors on Halloween to protect them from hazards and preventing them from being aggressive to visitors. Before you light those candles in your pumpkin, consider using inexpensive safety glow sticks. Nothing says spooky like a glowing green jack-o-lantern!
Costumes: It is important that when helping a child pick out a costume, safety should be the main concern. Wear a light-coloured or bright costume, reflective tape or arm bands to heighten visibility.
Wear a costume that is properly fitted to reduce the chance of tripping on it.
Select a costume that is constructed from flame-retardant materials. Make sure your vision is not restricted. Consider completing your costume with make-up rather than masks. Masks may require that the eye-holes be cut larger for the sake of good peripheral vision. Shoes should fit properly even if they do not go well with a costume. If a child’s costume requires the use of props, such as a flexible-plastic sword, make sure the sharp tip is cut or filed round. Glow sticks are also an excellent method to increase a child’s visibility. You might want to consider creating a fun necklace with string to ensure they will want to wear as part of their costumes. Accessorize with a flashlight!
Before the kids hit the streets, it is important that parents be aware of the route that their children plan to follow. If you are unable to take them out yourself, consider asking another parent, an older sibling or babysitter to do the honours for you. Ensuring your child is wearing a watch also allows you to establish an agreed upon curfew.
Teach your children to recognize the places along his/her route where they can obtain help: Police Station, Fire Station or any other well indicated public place.
Although tampering of loot is rare, remind children that they must have their candy inspected by their parents or guardian prior to eating them.
Some Rules for Trick or Treaters
Bring a flashlight;
Walk instead of running;
Stay on the sidewalks (If there is no sidewalk, walk on the left-hand side of the street facing traffic);
Avoid jaywalking;
Do not cut across lawns or take short-cuts;
Take masks off when walking from one house to the next;
Do not go inside houses and do not get into vehicles;
Only visit houses that are lit;
Stay away from animals you are not familiar with; and
Vandalism is not just a ‘trick’ – it is against the law and has consequences.
Avoid injury and be safe out there Ottawa !! Above all, have a safe and ghoulishly good Halloween!

Ottawa Brain Injury Lawyer : accidents – number one cause of brain injury.
Posted by Ottawa Personal Injury Lawyer, Ottawa Accident Lawyer, David Hollingsworth in Brain Injury / Head Injury, Ottawa Injury and Accidents on October 24th, 2009
“As a personal injury lawyer, I help a lot of clients who have a brain injury as the result of an accident. The Brain Injury Association of Canada recently put this out and I thought I would share it with you. Enjoy this upcoming holiday season and be safe out on the roads.” -David
Brain Injury Association of Canada urges Canadian drivers to drive safely, smartly and if you drink don’t drive– With the holiday season upon Canadians, the Brain Injury Association of Canada (BIAC) urges one and all to bear in mind that car crashes are the number one cause of acquired brain injury. Drivers who resist ‘holiday’ egg nog and other alcoholic drinks greatly reduce their risk of being involved in an accident which may harm them and others.
“At this time of year our call for safety is tied to reducing car crashes, and thus the number of people who become brain injury survivors,” explains BIAC executive director, Harry Zarins. Mothers Against Drunk Driving reveal that over 47% (2005 statistics) of North American car accidents occurring during the last week of December are caused by impaired driving.
Driving while drunk increases your chances of reacting too slowly to avoid even a slow-moving accident. Even a mild blow to the head can result in a lifelong, silent and unseen acquired brain injury; and serve as a sobering reminder that that nip of festive cheer wasn’t worth it—to you, or your family and friends. If you choose to drink, choose not to drive. BIAC strongly supports and applauds organizations, such as Operation Nez Rouge/Operation Red Nose.
Treating preventable injuries, such as acquired brain injury, costs Canadians $14.7 billion per year. This sum further compromises Canadian business in these economic times, lowers our standard of living, and strains our publicly funded health care system.
The Brain Injury Association of Canada wishes all Canadians a safe and happy holiday season.

What are Accident Benefits?

Accident Benefits – What are they?
Ottawa personal injury lawyer DAvid Hollingsworth explains…Accidents can happen to anyone at anytime. If you have been involved in a motor vehicle accident, be it car accident, bicycle accident, boating accident or motorcycle accident, you are required to contact your own insurance company within 7 days of the accident. Under current legislation, you are entitled to Accident Benefits no matter who caused the accident. However, the law requires that you to file an Application for Accident Benefits within 30 DAYS. That is why it is important for you to contact a personal injury lawyer as soon as you are able. If you have suffered a personal injury that prohibits you from doing so, appoint a friend or family member to initiate the discussions with a personal injury lawyer. You may want a lawyer that specializes in brain injury, a spinal cord injury lawyer or a local Ottawa personal injury lawyer.
If you have yet to file an Application for Accident Benefits, call David Hollingsworth, Ottawa personal injury lawyer. David is available, free of charge to explain the Accident Benefits system to you as you could be entitled to Income Replacement Benefits of up to $400.00 dollars per week, Attendant Care Benefits of up to $3000.00 per month, Housekeeping and Home Maintenance Benefits of $100.00 per week, and Medical and Rehabilitation Benefits of $100,000.00 for up to ten years, among other benefits.
Under the current system, further benefits are provided for persons that have been catastrophically impaired. David Hollingsworth is an experienced personal injury lawyer in Ottawa and along with his personal injury team have extensive experience navigating the Accident Benefits system.

Ottawa Spinal Cord Injury Lawyer Shares Information as it Relates to Spinal Cord Injuries.
Posted by Ottawa Personal Injury Lawyer, Ottawa Accident Lawyer, David Hollingsworth in Ottawa Spinal Cord Injury on October 12th, 2009
Spinal Cord Injury Treatment
Customarily, there are two stages of Spinal Cord Injury i.e. Primary Stage and Secondary Stage
The primary injury illustrates the initial physical trauma to the spine which may occur through severe fall, car accident, and any other such kind of traumatic incident.
Initially, primary injury is the result of neurological injury or spinal cord injury, possibly occur from:
I.Physical compression of the spinal cord/nerves: Due to injury, the bone, disc, and or ligament compressed the tissues and narrow down the spinal canal or sometimes also change its alignment. Consequently, nerves squeezed.
II.Stretch of the tissues: The spinal cord could be pathetically injured even in the condition of the least trauma attributed to it directly.
III.Blood supply mutilation: Due to injury, the inner capillary network or microscopic blood vessels could be smashed immediately. Resultantly cause instant hemorrhage or bleeding into the cord.
However, the injury of the spinal cord can be diagnosed on an MRI just after trauma.
The secondary injury is the cascade effects of the incidents in the body following the primary trauma. Nevertheless, for the occurrence of secondary injury, there is no fixed time, it could occur after seconds, hours, days, and even weeks. Abreast, there are numerous factors that determine the severity of the secondary injury. In the condition of secondary injury, body releases flow of chemicals in response to the trauma. Subsequently, these chemicals cause inflammation, reduce spinal cord blood flow, and ultimately cells die.
Treatment of the spinal cord injury is normally aimed at steps involved in the series of injury with the following distinctive objectives:
a.lessening inflammation
b.reducing degradation and cell death
c.escalating blood flow
d.diminishing scar formation
Primarily, the motto of treatment of the spinal cord injury is to concentrate on alleviating the injury. Afterwards, when it accomplished to its fullest, then the two other objectives of treatment focused viz ….
i.transplanting nerves
ii.nerve rejuvenation
I found this infomation on a related law blog and thought you might find it useful. I currently have several clients with a spinal cord injury and I understand how this is an incredibly difficult time for you, your family and your friends. Lawyer’s Perspective: What to do After a Car Accident.
After being in a car accident, motorcycle accident or other motor vehicle accidents, most of David’s clients are immediately relieved when David explains the insurance claim process.
In each case, there are 3 immediate questions that must be considered:
1. Accident Benefits – When I get into an accident, how do I make a claim for accident benefits from my own insurance company?
2. Liability – is the accident the result of someone else’s negligence? If so, do I have a right to make a claim against that driver’s insurance?
3. Damages – When I have been injured in a car accident as a result of someone else’s fault, what can I claim against the other driver’s insurance company and how much am I entitled to?
If you or a loved one has been injured or died as the result of an accident, you may be entitled to accident benefits you are not receiving. As an Ottawa lawyer specializing in personal injury, I meet with people daily who have been seriously hurt and need help.
