Pain and suffering compensation in Ontario, thresholds, deductibles and more…

Ottawa lawyer reports on Rockland accident highway 174 resulting in tragic death.
Ottawa Personal Injury Lawyer David Hollingsworth and Associates. Sadly, a man has died as a result of a car accident on Hwy. 174. east of Ottawa , close to Canaan Road just after 2 p.m. yesterday. Several rescue crews rushed to the Rockland accident scene to try to save the man’s life after his car lost control and rolled into a ditch somewhere between Cumberland and Rockland. The deceased was a 56-year-old man who was travelling with 3 dogs. When rescue crews arrived there was not much they could do as the driver had no vital signs when they arrived and sadly he was pronounced dead at the accident scene. My thoughts go out to his family and friends .

Rockland accident highway 174
Ottawa accident sends man to Trauma Centre at Ottawa Civic Hospital with severe injuries.

Ottawa Personal Injury Lawyers David Hollingsworth and Associates. A terrible accident on Richardson Side Road between Carp Road and Thomas Argue yesterday afternoon has left a 46 year old man with severe injuries. He was rushed to the Trauma Center at the Ottawa Civic Hospital Campus with serious multi-system injuries.
At the time of the accident, he was in critical condition. Another person was also injured. His passenger, 17-year-old male has some minor injuries and was transported to the Children’s Hospital of Eastern Ontario (CHEO) in stable condition. I wish both men a full recovery and my thoughts go out to their friends and family at this very stressful time.

Victoria day long weekend in Ottawa. What is open ? What is closed?

I hope you are all out there enjoying yourselves and keeping safe on the roads, waters or wherever you may be. Some of you may have been lucky enough to get away; others may be sticking around to cheer on our SENS tonight. If you are in Ottawa and are wondering what’s open and closed; here you go:
Ottawa Victoria Day:
Garbage, green bin and recycling collection are all cancelled on Monday. All garbage pickup is delayed by a day for everyone all week.
Most grocery stores are closed including Loblaws, Costco, Farm Boy and some Metro stores. If you find that you need a grocery store, don’t forget you can always cross over the bridge and head into Gatineau.
LCBO and Beer stores are closed.
Shopping malls are closed except for the Rideau Centre.Malls closed include Bayshore Shopping Centre, St. Laurent Centre, Place d’Orléans, Carlingwood Shopping Centre and Merivale Mall.
Museums in Ottawa will be open
Many pools and recreation centres will be open, however registered programs are cancelled on Monday. If you are unsure; it’s best you check and confirm.
Public libraries and municipal child care centres are closed.
This weekend is also the last days for the Canadian Tulip Festival.
OC Transpo will be operating on Sunday schedule on Monday.
City Hall and client services centres is closed.
Ottawa public health services is closed.
SENS Scotiabank is open !!!! Go SENS go.

Please do not drink and drive and please do not drive in any way that could cause you to lose focus: ie text and drive or talk and drive. Please be careful on the highways when you are travelling . The roads will be much busier and this always elevates the chance of an accident. Ontario roads are especially congested during a long weekend, and it only takes a split second of distraction to be involved in an accident. I also wanted to remind everyone to please not drink and drive.
According to recent statistics, Ontario’s roads are safer than ever. (newsontario.ca) The province has developed many road safety measures that are helping to save lives, prevent injuries and reduce the number of accidents on our road ways.
According to the most recent statistics, the number of road-related deaths is at the lowest ever recorded in Ontario and in North America.
- drinking and driving related fatalities – down 29%
- people killed in speed-related collisions – down 17%
- deaths involving large trucks – down 24%
- Canada has introduced some of the toughest laws when it comes to road safety, including
· - distracted driving - ticket issued
· – drinking and driving: 3 day licence suspensions for drivers and boaters with a blood alcohol concentration of 0.05 to 0.08 or if under 21 years of age with more than zero blood alcohol levels immediate suspension.
· -street racers and aggressive drivers who drive 50 km per hour or more above the speed limit will receive immediate, 7 day licence suspensions and vehicle will be impounded.
RIDE programs will be set up all over the province. Please keep our roads safe by not drinking and driving. It’s up to all of us.

Tragic death of rugby player Rowan Stringer hopes to bring education on the signs and signals of a concussion or brain injury. Do you know what to look for?

Ottawa Personal Injury Lawyers David Hollingsworth and Associates. The very tragic death of young Rowan Stringer has left the Ottawa community with great sadness. Rowan attended John McCrae Secondary School student in Ottawa and was the captain of the rugby team when she died from a severe head injury during a rugby game last Wednesday. Rowan Stringer was an avid rugby player and played on several different rugby teams.
It was reported that Rowan was tackled hard during the rugby game on Wednesday, flew into the air and hit her head and neck on the ground. Upon impact, Rowan was awake, sat up but quickly fell unconscious. Sadly, she didn’t wake up. She remained unconscious for days while medical team worked at relieving the pressure in her head and then on Sunday, her family made the most difficult decision of their lives. Rowan was taken to hospital, where doctors tried unsuccessfully to relieve the pressure in her head but there was too much pressure and the decision was made to discontinue life support.
Rowan’s parents, Gordon and Kathleen Stringer, told CBC News that their daughter had been complaining of headaches the week before and that she’d been hit in the head in a game the week before the fatal tackle. Then, just 2 days before the fatal injury, she was once again hit in the head during a rugby game. She didn’t report this second hit to her parents. The doctors are now investigating whether or not she may have suffered a smaller head injury that may have some impact on the fatal head injury.
Sadly, Rowan is now gone and she can’t be brought back. Her family is hoping that her death will help educate others on the signs and signals of brain injuries. Her organs have been donated to help save the lives of others. What an amazing thing for this family to have done after going through such a terrible tragedy.
The question now is could Rowan’s death possibly save lives in the future? I hope so and so does her family. The hope is that there will be more education as it relates to head injuries, concussions and sports. Rowan’s death has been widely publicized . The hope now is that all this publicity may save another life. As a Ottawa personal injury lawyer who helps people with severe concussions and brain injuries, I believe it is vital that we talk to our kids, coaches, teachers, caregivers, friends about the signs and symptoms of concussions. Our children and athletes need to know what to be looking for and to know to tell someone. I believe that if we really educate our athletes and their families, we can help reduce the number of deaths and further injuries.
Unfortunately, concussions are fairly common and can range in severity. It is estimated that a concussion or mild brain trauma is sustained every 21 seconds. The signs of a concussion so you can take the proper steps to treat the injury. The signs of a concussion also vary , which is why it is often difficult to determine if someone is suffering form a concussion or not. The following is not a comprehensive list, but does describe some of the symptoms one might have if they are suffering a concussion:
- confused or dazed
- clumsy
- slurring speech
- nausea or vomiting
- headaches
- off balance or dizzy
- blurred vision
- sensitive to light and noise
- sluggishness
- ears ringing
- changes in personality or changes in behaviour
- difficulty concentrating
- loss of memory
There are many more signs; however these seem to be the most common. As a Ottawa personal injury lawyer and as a father of 3 children involved in sports, I urge you to talk about concussions, what to expect and what to do. It could very well save a life. Rowan’s death is so incredibly sad and tragic that we owe it to her and her family to do everything we can to teach others about the signs and symptoms of a concussion. My thoughts go out to Rowan’s family and friends and this very tragic and difficult time.

Road Safety Week in Ottawa focuses on impaired driving, seatbelts, speeding aggressive driving and distracted driving.

Did you know that Road Safety Week is kicking off this week all across Canada ? Our local Ottawa Police, along with the Ontario Provincial Police (OPP) are steering the national campaign aimed with a goal to make Canada’s roads the absolute safest roads in the world. I’m all for that ! The Road Safety Week program hopes to remind people that traffic enforcement is present to save people’s lives and reduce personal injuries on not only Ottawa roads and Ontario roads, but roads all over Canada. We live in such a great country , not let’s all work at making it safer. The main focuses of Road Safety Week will be on impaired driving, proper use of seatbelts, speeding and lastly, drivers who drive aggressively and distracted. This focus will be perfect as we head into a long weekend that is famous for highway travel and sadly, accidents in Ontario. As a lawyer in Ottawa, I see far too many accidents in our community and most times they are avoidable . Please, think about your driving and be sure to set a good example for little eyes and ears that may be in the car with you. It is our job to raise responsible drivers and that starts with leading by example. Have a safe and wonderful Road Safety Week. Let’s keep it up all year !

Gatineau accident sends man to hospital with critical injuries.

A terrible accident in Gatineau has left a 29-year-old man in critical condition after an accident at Verger Avenue and Klock Road late yesterday. The driver was turning when his car was hit by another vehicle driven by a man in his 60s. Both men were rushed to a local hospital. My thoughts go out to the driver who remains in critical condition. I hope he is able to recover fully from this terrible accident.
