Ottawa and eastern Ontario freezing rain : Tips for driving in icy conditions, Ottawa lawyer David Hollingsworth

Ottawa Personal Injury Lawyers, Ottawa Accident Lawyer…Listen up Ottawa ! A freezing rain warning issued by Environment Canada for Ottawa and parts of Eastern Ontario is expected to continue throughout tonight and into the morning. The freezing rain has contributed to over 50 reported car accidents in Ottawa today and is suspected to be a contributing factor to a serious accident on highway 401 this morning that partially closed highway 401 for close to 9 hours,  near Kingston. Leaving over 100 cars stuck for hours.

Many school boards have closed cancelled their busses. The Upper Canada District School Board cancelled all buses but schools remained open. The Catholic District School Board of Eastern Ontario also cancelled all buses.

Ontario Provincial Police , Ottawa police and I are warning commuters to drive slowly on the icy roads in eastern Ontario. As an Ottawa personal injury lawyer, I also want to caution pedestrians to be careful while walking on Ottawa’s roads and sidewalks.  Cars may not be able to stop .Please keep your head up and be extra vigilant. Drivers need to also be aware that the sidewalks and roads are slippery and consequently be a lot more aware of pedestrians. The following are a few driving safety tips for driving in icy conditions.

  • If your car begins to slide on black ice, take your foot off the gas pedal. The last thing you want to do is give your car more gas. Slow down when you are driving on ice or in any winter conditions.
  • Don’t slam the brakes. Yes, it may be a natural instinct to slam on the brakes; however this will cause your vehicle to lose control and continue sliding. Pump your brake pedal gently instead of pushing down hard.
  • Look for dangerous trouble spots ahead. If you suspect that there is ice ahead, downshift to a lower gear before you hit the ice. The lower gear will allow you to drive more slowly and allow for better control of your vehicle.

    Kingston Accident: Boating Accident Howe Island St Lawrence River results in 2 wrongful deaths

    Ottawa Boating Accident Lawyer , Kingston Accident Lawyer David Hollingsworth ..Sadly, an Ottawa area boating accident claimed 2 lives Friday morning on the St. Lawrence River, off Howe Island, part of the Thousand Islands system, located between Kingston and Gananoque.

    4 men were boating on the St. Lawrence River near the east end of Howe Island when one man fell off the bow seat of the boat as it was making a turn. 2 of the other passengers jumped in to try to save him. Tragically, only one of them survived. a short time after, the two men involved in the Kingston boating accident ,aged 35 and 40, were pulled from the river and taken to area hospital where sadly, they later died as a result of the personal injuries suffered during the boating accident. Many other boats in the area attempted to help but unfortunately, they could not. My thoughts go out to the friends and family of these 2 men.

    The warmer summer months are here and our lakes and rivers are full of  motorboats, sailboats, jet skis, sea doos and other watercraft. Unfortunately, a large number of Ontario residents suffer serious personal injuries in Ontario boating accidents each summer. Please be careful out there as a boating driver, boating passenger and as a swimmer !

    Ontario Injury Lawyer David Hollingsworth: Stages of an Ontario personal injury lawsuit.

    Ottawa Personal Injury Lawyers, Ontario Accident Benefits, Ontario Personal Injury Lawsuits

    Stages of an Ontario personal injury lawsuit..

    After an accident, your world is turned upside down.  You may have lost a loved one or you may be in pain and unable to do some everyday tasks you once could. You probably have a million questions that need to be answered.  An Ontario personal injury lawyer can help answer any questions you may have that relate to Ontario accidents, personal injury, accident benefits, insurance claims, medical specialists, services available and more…Most people who come to me as an Ontario personal injury lawyer want to know how their case will proceed , how long it will take and what is the maximum compensation they are entitled to in Ontario.

    There is no one answer to these questions but after reviewing all the facts in your case, an Ontario personal injury lawyer can best give you an idea of what course to take and what compensation you are entitled to.

    What happened in an Ontario personal injury lawsuit?

    Shortly after you hire an Ontario personal injury lawyer, they will  notify the defendant (i.e. the person’s insurance company who you plan to sue) that you intend to file a claim. Typically the  insurance company will try to negotiate directly with you and hope that an Ontario personal injury lawyer does not become involved.  The reason for this is that typically Ontario personal injury lawyers can negotiate  a much much larger settlement amount in compensation.  They know how to develop a personal injury case to show not only what compensation  you need now but what compensation you will need in 20 years from now as the result of an accident.    If the insurance company does not offer you a reasonable amount  your Ontario personal injury lawyer will commence the lawsuit.  This is done by filing a document called a “Statement of Claim” with the Court office and then serving the defendant with the Statement of Claim.  The insurance company generally have their  own lawyers and will in turn file a “Statement of Defence”.

    The Ontario personal injury lawyer and the representative for the insurance company then exchange documents and proceed to “examinations for discovery”.  At the examinations for discovery, each side is asked questions about the accident by the other party’s lawyer.

    The best Ontario personal injury lawyers will  arrange medical examinations for you.  The insurance company is also entitled to have you seen by medical professionals it chooses, although there are limits on this right. This is not something you should be afraid of; don’t worry.

    Your Ontario personal injury lawyer and the insurance company can offer settlement compensation at any point and your Ontario personal injury case can be resolved at any given moment.  A lot of Ontario lawsuits are settled at a “mediation”.  A mediation in Ontario is an attempt to settle the case.  The Ontario personal injury lawyer and the insurance company agree upon  the mediator they want to reach a settlement amount in their personal injury case.  A few months before trial, there will also be a “pre-trial” meeting .  The pre-trial  meeting is a venue  whereby an Ontario judge can offer input to the Ontario personal injury lawyer, as well as the lawyer for the insurance company. Typically the Ontario judge will offer their opinions in regards to the strengths and weaknesses of the case.  Often times, cases settle at, or shortly after, the pre-trial meeting. Most Ontario personal injury lawsuits are settled before trial.  However, some lawsuit do not settle and  you will be given a trial date.  The unsuccessful party at trial can appeal the trial decision to the Court of Appeal for Ontario.

    How long does a personal injury lawsuit in Ontario take to resolve?

    The length of time it takes to resolve an Ontario personal injury lawsuit depends on many factors:

    * How quickly you respond to your Ontario personal injury lawyer’s requests for information and documents;
    * If the insurance company is cooperative;
    * How long it takes for your doctors to provide a report as to what the long term implications of your personal injuries will be;
    * How much time it takes to prepare and receive reports from doctors, other health professionals and other institutions;
    * How long it takes for the defence lawyer to arrange various defence medical examinations: and
    * How long it takes to obtain a trial date in Ontario.  The sooner you commence your lawsuit, the better.

    The most important thing you need to do after an accident is recover and rebuild.  You will need help and support. Ask for help from friends and family.  They are for you.  Don’t worry about your Ontario personal injury lawsuit. Your Ontario personal injury lawyer will do that for you.  They will represent you and fight on your behalf to ensure that you get everything you need and are entitled to. These are some of the most difficult and stressful times of your life; focus on yourself, family , friends and recovery.  By hiring one of the best Ontario personal injury lawyers, you can concentrate on your recovery.

    “I have rarely met with a client who is receiving the full amount of accident benefits that he or she needs and that he or she is entitled to following an accident in Ontario, without the help of a top Ontario personal injury lawyer. If you suffering from a personal injury or lost a loved one in a car accident, you owe it to yourself and to your loved ones to get every benefit to which you are entitled, so that you can get back to being the person you were before the Ontario accident. That’s what Ontario insurance is for. Don’t sell yourself or your family short. Let me help you…

    Avoiding Ontario Accidents , Lawyer David Hollingsworth Shares Highway Driving Safety Tips

    Ottawa Lawyers, Ottawa Accident Lawyer David Hollingsworth…Many of you will be heading out of town for this long weekend.  Whatever you may be celebrating this weekend, Passover, Easter, Ridvan etc…I want to wish everyone a safe and happy long weekend. If you are hitting Ontario highways, here are a few things to keep in mind to avoid a car accident in Ontario.

                                                                     -David Hollingsworth, Ontario Accident Lawyer, Ottawa Accident Lawyer

    Avoiding Ontario Car Accidents: Follow Ontario Speed Limits…

    For your safety and the safety of others, always obey the speed limit posted on Ontario highway signs along Ontario  roads and highways, but more importantly always drive  a speed that allows you stop safely.  Try to drive at the same speed as traffic surrounding you without going over the speed limit. In Ontario cities, towns, villages and suburb areas where there are no posted speed limit signs, the maximum speed is 50 km/h. Elsewhere the maximum speed limit is Ontario is 80 km/h.

    Ontario Accidents: Highway Driving Safety Tips:

    Slow down in bad weather, in heavy traffic or in a construction zone; Slow down at night, especially on dark roads; Always follow at a safe distance, at least 2 car lengths behind the vehicle in front of you.

    If you are charged for speeding at 50 km/h over the speed limit, Ontario police will suspend your licence and impound your vehicle at the roadside. Please be careful when driving through Ontario construction areas.  To avoid an accident in Ontario, slow down when approaching work zones and be ready to stop at a seconds notice. Most importantly, be patient if there is traffic . If your lane is blocked , yield to the driver coming from the opposite direction. When it is clear, move slowly and carefully around the accident. Use common sense. Observing speed limits means more than obeying the posted speed: it means reacting to road conditions. When it’s raining or foggy, when ice is on the road, when traffic is heavy or when road construction is ahead, adjust your driving speed accordingly.

    Ontario Car Accidents: Driving Safely on the Right….

    Watch for signs on Ontario highways that read “Left Lane For Passing Only.” Slower Traffic Keep to Right: These signs let you know that the left lane on an Ontario highway is not a “fast” lane; it is a passing lane. If you pass someone, move into the right lane once you’ve safely cleared the vehicle. Slowing down the flow of traffic by continuing to drive in the left lane is not only dangerous but can result in a fine in Ontario.

    Ontario Highways Accidents: Truck Accidents

    Trucks can weigh close to 85,000 pounds and take extra time to stop. Drive cautiously on a highway that has several large trucks. Maintain a safe following distance. Don’t squeeze between trucks and the curb. Trucks make wide right turns, and the truck driver may not see you.When passing a truck, don’t move back into your lane until you can see both truck headlights in your rearview mirror. Make sure to give yourself enough room.  Trucks have blind spots of up to 20 feet in front of the tractor, anywhere along the sides of the trailer and up to 200 feet behind the trailer. Keep that in mind. Never drive behind a truck that is backing up.

    Avoid Ontario Highway Accidents by Moving Over..

    When you approach an emergency vehicle with  flashing lights, move a lane away , or slow down well  below the posted speed limit.

    Some Ontario Highway Accidents Could be Avoided From Simply Resting…

    It takes a split second to lose your focus. Maybe you can’t stop yawning?  Your thoughts wander or you’re drifting between lanes? You need to be alert !  Get plenty of rest before you hit Ontario highways. Get out of your vehicle and stretch your legs every so often. Take a break for 20 minutes at each stop. Yes, it will add time to your trip..but what is more important? Try to avoid driving between midnight and 6 a.m. Never  drink and drive -  small amounts of alcohol can impair your judgment and your reaction time.

    Stop at Ontario Highway Rest Areas….

    Take a break and advantage of the Ontario Highway Rest Areas and Ontario Information Centres. At most stops, you can get information on restaurants, road conditions, gas stations, snacks, area tourists stops etc…plus most often they have picnic tables and washrooms…a great place to stop for a packed lunch or snack.

    Please, drive safely out there !!!
