Changes to Ontario Accident Benefits and the Minor Injury Guideline.

Personal Injury Lawyer Ottawa, David Hollingsworth…The Financial Services Commission of Ontario has again made some changes to Ontario accident benefits and unfortunately, in my opinion as an Ottawa personal injury lawyer, these changes do not favour Ontario drivers, should they become injured in an accident and need to access their accident benefits.  One of the  recent changes in accident benefits  has to do with the MIG (Minor Injury Guideline)  and it requires a pre-existing condition to have been included in a medical note by a health professional to get out of the Minor Injury Guideline.

As of February 1, 2014, the Government of Ontario has decided that Ontario drivers who are accessing their accident benefits and who fall under the Minor Injury Guideline are limited to the cap of $3,500.00 UNLESS they have a  pre-existing medical condition and this pre-existing medical condition must have been documented by a health practitioner prior to the accident.  This is a new requirement. Before February 1, 2014,  pre-existing medical conditions did not need to be documented.  Essentially , what this means is that if you were injured before but had perhaps  not sought out medical treatment that was documented, then you will not be considered for the exclusion of minor injury guidelines and most likely your treatment will be limited to the $3,500.00 cap.

This change in accident benefits highlights why it is critical to treat any injury as serious. Most people think things will heal naturally over time and often can’t find the time to get to the hospital or doctor.  With wait times the way they are, it is understandable; however these types of changes highly why Ontario drivers need to make this a priority. Unfortunately, once an accident has occurred, you can’t turn back the clock.

An Ottawa accident has left a 62 year old man is serious yet thankfully stable condition.  He was walking when he was hit at the corner of Bank street, close to Gladstone yesterday afternoon at around 4:00pm. Ottawa rescue crews arrived to the accident scene and found out that a car was travelling at a speed of 50km/hour when it hit the pedestrian.The impact of the crash was so severe, it sent the pedestrian flying and he landed close to 10 feet away from where he was hit. It was reported that the driver had been driving approximately 50 KM/hr when they hit the pedestrian, send them flying a good 10 feet. This impact caused a severe head injury , which was thankfully stabilized en route to Ottawa’s  Trauma Centre.

Ottawa Police are urging anyone with information that relates to this Ottawa accident to please come forward with any available information.

Tragic Ottawa rollover accident Upper Dwyer Hill at March road: car submerged in water filled ditch.

Ottawa Personal Injury Lawyers David Hollingsworth. Sadly, a 43 year old woman died yesterday at an Ottawa hospital. She had been submerged under water car after her car  flipped and landed in a ditch filled with water on Upper Dwyer Hill Road at March Road. Emergency crews got the call around 8:15, but tragically Ottawa firefighters couldn’t help the woman. They had to first tow the car out of the water ditch and turn it over before Ottawa paramedics could try to start to save her .   She was air-lifted to an Ottawa hospital and sadly she succumbed to her injuries. My thoughts are with her family and friends at this very sad and difficult time.

A 14 year old boy remains in an Ottawa hospital after being hit by a vehicle yesterday when he was riding his bicycle. The Ottawa cycling accident occurred at the corner of McArthur Avenue and Lafontaine Avenue in the early morning hours. The teenage Ottawa cyclist was hit and landed on the hood of the car that hit him and then fell to the ground. He suffered very serious personal injury; including a back injury. The Ottawa Police services has a comprehensive website with valuable information for Ottawa residents. I stumbled across their accident reporting information and thought I’d share it with you.

  • A police report is not required when damage to all vehicles is under $1,000.
  • If there are personal injuries and the vehicle(s) cannot be driven,  9-1-1 should be contacted.
  • If there are no personal injuries, but the vehicle(s) cannot be driven, call 613-230-6211
  • If the vehicle(s) can be safely driven and there are no personal injuries, drive all vehicles to the same Police Station and  file an accident report. Important to note: Accident reports cannot be taken over the phone.

The Ottawa Police Collision Investigation Unit …

is responsible for investigating all fatal and serious life threatening motor accidents.  They also investigate hit and run/ fail to remain accidents.

Accident Highway 17 results in wrongful death, Ottawa lawyer David Hollingsworth

Ottawa Injury Lawyer David Hollingsworth.. A terrible accident on Highway 17, north of Renfrew has left one woman dead and others with injuries. Highway 17 was closed between Haley Station and Cobden, from Cheneaux Road to Forresters Falls Road. The deadly accident involved 3 vehicles  on Highway 17 yesterday morning.  The Ottawa accident occurred when a dump truck was travelling west on the highway and hit the back of a transport truck, which spun into the eastbound lane, and tragically crashed head-on into a car around 7:30 a.m, killing the female driver. The cause of the accident is unknown and investigators are trying to determine why the dump truck was unable to stop. Ottawa motorcycle accident West Hunt Club Road results in serious leg fracture.

He was involved in an accident when his motorcycle collided with a car in Nepean yesterday afternoon close to West Hunt Club Road near Merivale.
