What do I do at the scene of a motor vehicle accident ?

DO:

  • Remain at the scene of the accident.
  • Call the police and advise of the nature of injuries suffered.
  • Provide the following information: your name and address, your vehicle permit number, and the name and address of the owner of the car (if it is not your car).
  • Get the names, address, phone number, vehicle permit number and insurance information from the other driver(s) involved.
  • Get the names, address, and phone numbers of any witnesses.
  • Write down anything anybody says about how the accident happened.
  • Tell the police officer if you think another driver is under the influence of alcohol or drugs.

DO NOT:

  • Move the vehicles, or any debris, unless they are a potential hazard to other motorists; or
  • Sign documents or discuss the accident with anyone but the police.

What should I do after the motor vehicle accident ?

DO

  • When you get to the hospital or to your home, you should call your insurance agent immediately.  If you do not have your own insurance you may be entitled under someone else’s policy or through the Ontario’s Superintendent of Insurance through the Motor Vehicle Accident Claims Fund.
  • Make an appointment with your family doctor or attend a walk-in clinic.
  • Take photographs of any damage to your car, truck, bicycle or motorcycle.
  • Contact a personal injury lawyer.
  • If you have any visible injuries, take photographs of these injuries.  Also take photographs of any damaged clothing or belongings.
  • Contact your employer or school and advise them that you were in an accident.
  • Consider your needs for specialized equipment and home modifications.
  • Keep a detailed record of all medications taken, assistance received from family, friends or professionals, all rehabilitation or doctors’ appointments, progress or development in physical, psychological or mental injuries, and all out of pocket expenses including parking, wheel chair rental, ambulance bills etc..
  • Comply with all requirements of the Accident Benefits.
  • Let your personal injury lawyer assist in completing the Accident Benefits forms.

DO NOT

  • Provide any statements to your insurance company until you have consulted with a personal injury lawyer.

Infant and Child Car Seat Safety. Have you buckled your child properly?

Canadian Safety Council: Buckle-Up Basics

The correct use of a child restraint on every trip can prevent 75 per cent of crash-related deaths and serious injuries to child passengers. However, roadside checks find only 51.6 percent of children buckled up at all. During 2002, Buckle Up Bears clinics found that less than 20 percent of all car seats checked were correctly installed.

These tips from the Canada Safety Council will help you make sure your child is properly protected in the car.

The Fundamentals

  • Make sure the restraint system has CMVSS (Canadian Motor Vehicle Safety Standard) on the label and comes with full manufacturers instructions.
  • Check the weight and height limits of the seat to be sure that it is correct for your child.
  • Before you buy a seat, try it in your vehicle to be sure that it can be installed properly and can be tightened so there is little movement.
  • Always follow the instructions according to the child seat manufacturer’s manual and the vehicle owner’s manual.
  • Transport Canada recommends that children 12 and under should be properly restrained in the back seat especially if there is a passenger-side air bag.

Rear-Facing Infant Seat Birth to 10 kg (22 lb.)

  • An infant-only seat offers the best fit for young babies. When your child is over the height OR weight limit of the infant-only seat, you can use an infant/child seat in the rear-facing position.
  • Make sure the harness is snug, (only one finger should fit between the harness and the baby’s collar bone). The chest clip should be positioned at armpit level.
  • When tightening the vehicle seat belt, push the infant seat down and into the upholstery, and pull the belt as tight as possible. There should be very little movement.
  • WARNING: Never place a rear-facing child restraint in a seat equipped with an air bag.

Forward-Facing Child Seat 10 – 18 kg (22 – 40 lb.)

  • When your child weighs 10 kg and can pull to a stand independently use a forward-facing seat. Before this, the neck and back muscles and bone structure are not strong enough to withstand crash forces.
  • Make sure the harness is snug, so that only one finger can fit between the harness and the child’s collar bones. The chest clip should be positioned at armpit level.
  • When tightening the vehicle seat belt, kneel in the child restraint to push it down and into the upholstery, and pull the belt as tight as possible. There should be very little movement.
  • All forward-facing child seats must be anchored to the vehicle frame with a tether strap. Check your vehicle owner’s manual or your dealership for tether anchor locations.

Booster Seat 18 kg (40 lb.) or over

  • The child must weigh 18 kg before moving to a booster seat. If the mid-point of your child’s ears is over the back of the child restraint but he/she is not yet 18 kg, use a combination child seat/booster.
  • A booster seat raises the child to fit the adult seat-belt properly.
  • A booster that uses a lap/shoulder belt provides the best protection for your child.
  • Use a booster until your child is over the manufacturer’s upper weight limit or height limit, or the mid-point of the ears is above the top of the high back booster or the vehicle seat.

Seat-Belt

  • 1.45 m (4 ft. 9 in.), or 36 kg (80 lb.), or 8 years of age (Also check your provincial or territorial regulations as this regulation differs from one to the next).
  • When your child has outgrown the booster seat, start using the lap/shoulder belt on its own.
  • The key to using a seat-belt safely is positioning. The lap belt should be worn low on the hips, touching the upper thighs, to prevent abdominal injuries or spinal damage. The shoulder belt should be worn over the shoulder and across the chest.
  • The child should sit fully upright, with back against the vehicle seat. To prevent slouching, the legs should be long enough to bend over the front of the vehicle seat. This will prevent the lap belt from riding up over the abdomen. To fit most shoulder belts, the child should have a sitting height of at least 63 cm (25 in.)

Ottawa Lawyers, 2 most common questions asked of Ontario personal injury lawyers

Ottawa Car Accident Lawyer, Ottawa Lawyers- The 2 most common question I receive as an Ontario personal injury lawyer are “Do I have a case” and “How much is my case worth?” .  My response is  “It depends…” Depends on what?  Well, lots of things really. In any given Ontario accident claim there are several factors that determine the maximum amount of compensation in an Ontario accident claim. Here are a few:

Extent of personal injuries – Are they permanent or only temporary personal injuries? Obviously, a permanent injury represents a greater value than if the injury eventually heals.
Cost of care – How much treatment have you received? A person that needs medical care for the rest of their lives will have a much bigger personal injury and accident benefits claim then if the person only needs care for a short time.
Type of personal injury– Are they catastrophic injury such as a spinal cord injury or a brain injury? Is the personal injury life-changing? Or can the accident victim do everything he or she could do before the accident?
Facts of accident – Was the accident severe and dramatic, or was it a minor fender-bender with not much visible damage to the vehicle?
Pre-existing medical history – Did the victim have a non-existent medical history so I can more easily prove that the subject accident was the sole cause of the injuries and ongoing complaints? Or does the victim have numerous prior and similar injuries or symptoms before the accident so the insurance company can raise serious questions about whether the accident was the cause or not?
Can the accident victim return to work?

These are examples of the most common factors that can affect the value of any personal injury case in Ontario. But there are many others. Because there are so many variables that go into an evaluation of a Ontario personal injury claim, no two cases are the same. That means two cases that appear to be similar or identical on the surface (same personal injury, same treatment, etc.) can actually produce widely different settlements and amounts of compensation.

As an Ontario personal injury lawyer and an Ottawa car accident lawyer who routinely reviews personal injury cases, I can also tell you that it may take time to determine the real value of a case.  Often times, personal injuries can take months or years to heal. The full extent of injuries is often until the accident victim goes through many months or years of treatment.  Some personal injuries just take time to resolve.

There is no one right answer, nor  formula to can use to determine the value of a personal injury.  I wish it were that simple. If you want to know the likely value of your personal injury case, you need to consult wiht a personal injury lawyer. This is especially true if you have a serious personal injury claim, or if you have personal injuries that are  severe, and long lasting, and when the medical expenses are piling up. Don’t take chances by damaging your case and dealing directly with an  insurance adjustor, or by settling the personal injury case for an amount that is  less than what may be fair and what you may need in the long run. Your personal injuries may still be unknown, as they sometimes take years to truly show themselves fully.

Ottawa motorcycle attorney reports rise in Motorcycle accidents results in increase in head injuries, accident deaths,

As an Ottawa lawyer, I seem to be getting calls almost daily about bicycle accidents and motorcycle accidents victims needing an Ottawa lawyer.  It seems like there are more and more each day.  Are there more people on motorcycles and bicylces?  I recently came across this on a related law blog and thought I’d share it with you…

Consumer Reports recently posted an article about the rise in motorcycle fatalities and also about the fact that supersport motorcycles have been found to be the most dangerous type of motorcycle. According to the Insurance Institute for Highway Safety, motorcycle deaths have doubled in the past 10 years reaching 4,810. And although these deaths have been on the rise, car accident deaths have been steadily decreasing.

According to the IIHS the supersport bike riders’ deathrate is four times higher than other bike riders. These bikes made up less than 10 percent of registered motorcycles in 2005 but accounted for over 25 percent of rider deaths. The fatality rates for cruiser and standard riders was 5.7 deaths per 10,000 registered motorcycles. Touring bikes, such as the Harley example, averaged 6.5 deaths, with sport having 10.7 deaths per 10,000.

According to the study, speeding and driver error were bigger factors in the fatalities involving supersport bikes in comparison the other types of motorcycles. Alcohol was also a factor in 19% of the supersport fatalities, however it was an even bigger factor in the touring, standard and cruiser motorcycles.

Although there are more people riding motorcycles, there are fewer people deciding to wear a helmet while riding. The most effective way found to reduce head injuries is to wear a helmet that meets all of the federal safety standards. Of the motorcycle fatalities in 2005, 700 of those lives could have been saved if they were wearing a helmet.
