Car Accident Rideau Ferry Road results in serious personal injuries, Ottawa Accident Lawyer

Ottawa Car Accident Lawyer David Hollingsworth, Ottawa Personal Injury Lawyer…A single-car accident early yesterday morning on Rideau Ferry Road at the intersection of Elmgrove Road in Drummond North Elmsley Township sent two passengers to hospital with serious personal injury and has the driver facing several charges. A Chevrolet Impala driven by a 32-year-old Havelock-area man, was travelling north on Rideau Ferry Road when it left the highway and ended up in a ditch, say the OPP. The two male passengers, from Campbellford, were taken by air ambulance from the Great War Memorial Hospital in Perth to The Ottawa Hospital’s Civic campus, suffering from serious, but not life-threatening injuries, said OPP Const. David Bird. I wish them both a full and most importantly a healthy recovery.  The driver was treated in hospital in Perth but did not sustain serious injuries and is expected to be released today, he said. The driver was charged with careless driving and also with the offence of “novice driver–blood alcohol content above zero.” The second charge comes under recent amendments to the Ontario Highway Traffic Act. Bird said it hasn’t been established yet whether the driver ever had a previous licence or if he had to obtain a new driver’s licence. The road was closed for about 50 minutes but has since re-opened.

Lanark Car Accident results in personal injury, Ottawa lawyers

Ottawa Car Accident Lawyer, Personal Injury Attorneys David Hollingsworth..I wish this man well and hope to hear of a full recovery. An elderly man from Ottawa was airlifted to hospital with critical injuries after his vehicle rolled into a ditch in Lanark Highlands Township Wednesday afternoon. The 72-year-old man was travelling on Watson’s Corners Road between Dobbie Road and Concession Road 2 when his vehicle left the road at about 4:40 p.m. He was transported by air ambulance to the Ottawa Hospital’s Civic campus with life-threatening injuries. There were no passengers in the vehicle. The cause of the collision is under investigation by the Ontario Provincial Police. Alcohol is not being considered a factor. Police were unable to immediately answer whether the man was wearing a seatbelt or whether speed is being considered a factor. The name of the man has not been released.

IMPORTANT TIPS FOR YOU AND YOUR FAMILY RE: ONTARIO’S NEW AUTO INSURANCE RATES

Hello everyone, I would like to share a quick note with you regarding Ottawa’s new auto insurance policy and what it will mean for you and your family, which is set to change for September. I am urging all my family and friends to be careful not to blindly accept the lowest possible Ontario auto insurance coverage just to save a few bucks – get the facts to be informed!

THE FACTS

Basically, the new policy acts to lower the minimum required rehabilitation coverage in our province by 50%, from $100,000 to $50,000. Furthermore, your coverage for the treatment of minor injuries now has a cap of $3,500. Settling for the new basic insurance package could mean that you or your loved ones are left to suffer after a personal injury in our province, without the adequate rehabilitative services that you will require. There could be a slight dip in auto insurance rates for some drivers when the new rates kick in, but depending on how, where, and why you drive (and who insures you), the average decrease in Ontario auto insurance will be somewhere in the realm of 0.01% to 7%. This means that you could see no change at all in your rates, but would still lose out on important features that would protect you in the event of an auto accident – a time when you will require as much help as possible to help you in your recovery.

$3,500 CAP for “MINOR INJURIES”.

The cap of $3,500 is not adequate in any way to deal with the majority of minor personal injuries, especially given that so called “minor” injuries can become worse over time. The new policy defines minor injuries to include such things as a sprain, strain, whiplash, contusion, abrasion, laceration, partial dislocation of a joint or organ and any pathological condition resulting from a personal injury. This list is not inclusive enough to include many coverage benefits that you will require and I would recommend to you that you read your terms carefully to ensure that you can keep the current accident benefits, because although you will be paying a bit more, it will act to protect you by safeguarding your interests. I estimate it would cost approximately $150 more per year on a one-driver, one-vehicle plan, depending on the insurance company. If you consider the benefits this is a good choice, because even though it seems like you’re paying a bit extra of your hard earned cash, consider the enormous costs of treatment you would lose out on if you experience personal injury from an auto accident and are left to handle all the financial costs for yourself. Drivers in Ontario with an existing policy will receive the same coverage after September 1st, until that policy expires. Those are the facts to consider. Ultimately, my hope is that you and your family will continue to be safe and will have the coverage that you need if you are ever involved in the unfortunate circumstance of an auto injury.  Please be safe and take care.

Ontario Auto and Car Insurance Changes : Be prepared -Ontario Personal Lawyer David Hollingsworth, in Ottawa

Ottawa Accident Lawyer-  Ontario Personal Injury Lawyer David Hollingsworth- The Ontario government has made changes to your auto insurance policy that have a direct impact on each and every one of us and come in effect September 2010. 

Ontario Auto Insurance Changes:  This summer, all Ontario drivers will be faced with the important decision of  whether or not  to purchase optional insurance -a basic automobile insurance package with reduced statutory accident benefits. My fear is that unfortunately, times are tough and most drivers will most likely opt for basic coverage.
 

Will you be affected? If you are in an accident and suffer a non-catastrophic personal injury, the answer is YES, you will.

Drivers with insurance who are in an accident and are deemed to have a  non- catastrophic injury are the ones most negatively impacted by the Ontario government’s changes. The Ontario asterngovernment is in the process of creating a basic insurance package of statutory accident benefits that lowers compulsory Medical and Rehabilitation benefits coverage to $50,000 from the previous  $100,000. Attendant Care benefit insurance coverage will be reduced in 1/2 to $36,000 with other important restrictions.

As an Ontario personal injury lawyer, I highly recommend drivers to purchase the optional increase in Medical and Rehabilitation benefits for up to $1 million (which would include $72,000 for Attendant Care). Unfortunately the reality is most drivers will probably purchase the basic coverage. This, is in my opinion dangerous.

There are also major reductions in accident benefits for accident victims with a non-catastrophic injury claim. The Medical and Rehabilitation and Attendant Care benefits have been drastically reduced and  Housekeeping and Caregiver benefits (unless you are catastrophically injured) have been completely eliminated. In most cases the at-fault insured driver will bear the costs of the reduction in the accident benefit insurance claim.

The definition(s) of catastrophic impairment has also changed, making it more difficult for accident victims to access their benefits. Assessment costs will now be deducted from the medical and rehabilitation benefits and that change will reduce the benefits available considerably. This means the costs to assess your needs will now come out of your benefits, which is now reduced and capped. Meaning again, less compensation for Ontario accident victims.  

Also of note, the definition of a catastrophic impairment  changed and now will include single limb amputees and the evaluation of catastrophic impairment will be restricted to those practitioners who have both training and experience with catastrophic injury cases.

Unfortunately, basic auto insurance coverage does not adequately compensate Ontario accident victims and their families with the costs that are necessary in most accidents. I sincerely hope and recommend to everyone to purchase the extended coverage; knowing that will be difficult for a lot of people to come up with the extra funds each year; but in my opinion, this is an expense you don’t mess around with. I urge you to do what you can do to purchase the extended coverage.

At the best of times, Ontario’s car insurance regime is complicated and difficult to understand. If you are injured in a car accident in Ontario, you are probably entitled to certain “no-fault benefits”, but you may also have the right to sue at-fault parties for your personal injury. The right to sue is not unlimited in Ontario. Ottawa Police have reopened Walkley Road between Cedarwood Drive and Heatherington Road, which was closed Thursday afternoon after a 13-year-old Ottawa boy was struck by a vehicle. Ottawa Paramedics treated the boy for a life-threatening head injury and transported him to an Ottawa hospital, where his condition is listed as critical. Ottawa Police are still investigating the cause of the car accident, which was one of dozens of collisions that happened across the city during yesterday afternoon’s whiteout conditions. Police warned commuters to drive safely as nasty winter weather creates whiteout conditions in some areas. They reminded motorists to give themselves plenty of room to stop when they approach intersections and encouraged them to leave space between vehicles.

The holiday season is a time that many share with family, friends, and loved ones. It is a time to be generous and grateful for the things in life that we often take for granted, such as the health and happiness of our friends, family, and ourselves. Unfortunately, the holidays can also be a time of tragedy and loss for pedestrians, drivers, and shoppers in the context of road safety and weather considerations.  Consider the following advice to keep your friends and family safe from serious car accidents and personal injury during the holiday and winter season:

Even though you may take the best of precautions to ensure the safety of you and your loved ones, it is still possible to become the victim of another’s negligence. Let us spend this holiday season in safety by considering the small but important ways we can all prevent and avoid situations of personal injury, accidents, and tragedy:
 

DRIVING

Good snow tires can help to keep your car on the road when it doesn’t want to be. Even if your car is in good working condition, it can still hydroplane, contact dry ice, or generally lose control if it is not properly equipped with the right snow tires. Tires require adequate air pressure, and tread. Your gas tank should be about half-full to ensure a freeze-up doesn’t occur. A good mechanic can confirm proper function of all components, including battery, and antifreeze levels.

EMERGENCY KIT

An emergency kit can be useful to have in your car. They can often be bought at any comprehensive hardware store. A good kit will include such things as (1) jumper cables (2) flashlights, (3) first-aid kit (with the useful emergency blankets), (4) blankets,  (5) signal flares, (6) waterproof candle/matches (7) and water. You can always add to your own emergency kit, by including such things as a mobile phone, non perishable power-bars, an object of sentimental value, and so on. The idea is to include anything that could help you in a time of need.

DISTRACTION

When drivers are distracted, they can be as dangerous and drunk drivers because many accidents occur due to the neglect of the person behind the steering wheel. It goes without saying, drinking and driving puts the lives of everyone on the road at risk, and is advised against. Most accidents occur because a few distractions are combined all at once to lead to a major accident (i.e. a driver has only consumed one drink, but the combination of the bad driving of another car, poor visibility due to snow, and driver talking on the phone, putting on makeup, reading the paper, texting, etc. leads to a serious accident). (By the way, talking on the phone while driving is now prohibited in our city of Ottawa) 

PATIENCE + RECKLESS DRIVERS

Allow for extra time to do routine tasks. Generally, it will take longer to drive in winter conditions due to climate factors such as snow and hail, while social factors include increased traffic of people driving to see family or go to the cottage for the holidays. Many people fail to anticipate the need for extra time and drive in a reckless manner, endangering their own lives and the lives of others on the road. Safe-guard yourself against the reckless drivers and please take care on the roads.

SLIP AND FALL Accidents

The last thing you want to do is spend your short holiday break in the hospital recovering from a slip and fall.  Always remember to watch out for wet spots and potential slippery areas in shopping malls, supermarkets, offices, etc. Try to shake the snow of your shoes to expose your shoe traction for better grip upon the ground. Most facilities will have rubber mats to remove the moisture from your shoes for additional traction. Comfortable shoes with good tread can make a world of a difference in preventing a slip and fall.

CRIME

Statistically, the rate of crime peaks somewhat during the holiday season. Please be aware of your environment when shopping, and generally out and about. In particular, avoid ATM machines in locations that you feel are unsafe or when you are by yourself. Remember to limit your shopping to stores that are equipped with (1) adequate security (2) well-lit parking, and (3) entrance and exit ways.

Again, as with all the advice, exercise your common sense and know that your attention to these matters acts to decrease your risk, and focus on what really matters – the opportunity to share your time and energy with your friends, family, and loved ones during the holiday season and beyond.

Ottawa man dies in ATV accident

A Fort Hood soldier died over the weekend in an ATV accident while home on leave. Stephen Ray Brown, 21, of Ottawa, Kan., died Saturday in Greeley, Kan. in an ATV accident while home on leave. Brown, who joined the Army in August 2007, was a patient administration specialist assigned to Headquarters, Headquarters Company, 3rd Brigade Combat Team, 1st Infantry Division (Rear Provisional). He deployed in support of Operation Enduring Freedom from July 2008 to June 2009, Fort Hood said.

When deciding upon a settlement for your personal injury claim, Ottawa lawyers must consider many different factors. It is not a simple process by any means. There is no way for lawyers to know up front how much you will end up with; it depends on the details of your case along with certain formulas. Unfortunately, some Ottawa lawyers will try to woo you by promising you a large settlement amount. This is typically done so that you will hire them without looking at other determining factors such as their track record and experience.
Damages
First you must understand what damages you are entitled to. If your accident or injury caused you to miss time and wages from your work, you are entitled to receive those lost wages in your compensation. If your injury requires you to take long term disability, you should be compensated for that as well. Any property damages as a result of your accident, as well as emotional trauma and medical bills from physical trauma, these are all things that you will want to calculate in as damages for your compensation. Experienced Ottawa lawyers can help you figure out what your damages are from your accident and ensure that you are properly compensated.
The reason that most Ottawa lawyers can not immediately assess your probable settlement amount also lies in the fact that some damages are subjective. For example, mental anguish can not be calculated in a dollar amount. It is up to analysts to calculate a reasonable number, typically using a formula, to decide how much is appropriate to attribute to these damages. If your mental damages are debilitating or lifelong, you will be awarded a much higher sum than if your damages are slight.
Who’s More at Fault?
Another factor in determining settlement amounts is the percentage of fault. In order to win a case, Ottawa lawyers must have evidence that the accident or injury was due to the negligence of the other party. However, 100% of the injury need not be their fault. Typically some of the blame may lie on the side of the injured party, and in that case the insurance company and the victim can come to a conclusion as to what percent of the accident was the fault of the injured party and what percent was the fault of the other party.
Once a conclusion has been reached, there is a new calculation of the possible settlement amount. After adding up all of the damage amounts, including lost wages, disability, mental anguish, and anything else you may feel entitled to, the percentage that is attributed to your fault is then taken out of the equation. For example, if your damages total $1,000, and it is decided that you are 30% to blame for the accident, you would be seeking out $700 in compensation for your losses. Experienced Ottawa lawyers may try to argue for more on your behalf, but this is the number that will typically begin the negotiations.
