Ottawa Glebe Collegiate Teen Drowned in Swimming Accident

Ottawa Area Water Accident..The family of Hay Mu Tha Kyu and students at Glebe Collegiate Institute are mourning the loss of one of their own. The school was mourning Hay Mu Tha Kyu, 15, who jumped off a cliff into Charleston Lake while out swimming with friends Saturday and didn’t surface. His body was found yesterday afternoon.

Hay Mu Tha Kyu is remembered as an energetic boy and a talented basketball and volleyball teammate. Hay Mu Tha Kyu was very popular at Glebe Collegiate and had a large circle of friends.  Some of his friends reported to the Ottawa Citizen that people were drawn to him . Hay Mu Tha Kyu was a young boy when his family fled war in Burma to a refugee camp in Mae La Oon, Thailand. That’s where another friend, Pahgalay Kyu, 18, got to know him. Pahgalay Kyu became friends with Hay Mu Tha Kyu  during the years they spent at the refugee camp. Once both families came to Canada, their friendship continued, and they spoke daily through text messaging.

Kyu had been swimming with two other young males when he jumped off the rock cliff at about 6:45 p.m. Saturday and never resurfaced. His family was there when the body was recovered.

This very sad accident serves as a reminder to us all that we are not invincible and accidents can happen at any time.  Please enjoy this summer and all this beautiful weather, BUT BE SAFE !!  My thoughts go out to everyone who was touched by Hay Mu Tha Kyu, especially his family.

Ottawa Accident Death Phillippe Lalonde, Ottawa Accident Highway 417

Ottawa Injury Accident Report:  Death of Philippe Lalonde as the result of fatal crash on Hwy. 417 last Thursday.  Philippe Lalonde was  32 and was travelling alone when it crashed into a concrete pillar and burst into flames around 11:30 p.m. A by-standard tried to free Philippe from the burning car but unfortunately was unable to save him. When he arrived at Phillippe’s car, it was already engulfed in flames and the fire quickly spread.  Ottawa firefighters were at the Ottawa accident scene and were able to put the fire out . Phillippe Lalonde’s mother-in-law said her daughter wants everyone to know Philippe “was an amazing man.” Lalonde, 32, ran his own contracting business called Philippe Lalonde Renovations.

West Carleton Motocross Accident, young boy suffers back injury and facial injuries, Ottawa lawyer David Hollingsworth

A young 14-year-old boy was rushed to an Ottawa hospital by helicopter late yesterday afternoon after a motocross accident in West Carleton. The motocross accident took place in a field near the intersection of John Shaw Road and Kinburn Side Road. The young boy suffered serious personal injury including back and facial injuries. He was flown to the Ottawa Hospital’s Civic campus trauma unit and thank fully arrived in stable condition.

Winchester Accident results in critical personal injuries, Ottawa Lawyer

Winchester Car Accident, Ottawa Lawyer David Hollingsworth..Yesterday police responded to a report of a single car accident on County Road 13 near the Winchester/Finch Twp Boundary border (in North Stormont). Investigation revealed a 2003 Nissan Maxima, driven by Emile SMILEY (72) of Nepean ON, was westbound on County Road 13 when, due to a medical episode, failed to negotiate a curve, left the roadway and struck a tree. The driver (lone occupant) was extricated from the vehicle and taken to Winchester Hospital and later transferred to Ottawa Hospital with life-threatening injuries. A section of County Road 13 was closed to traffic (2-8:00pm) as officers, assisted by Technical Traffic Collision Investigators tended to the scene.The investigation continues.

Social Host Liability..Do whatever it takes to keep your guests safe..Ottawa lawyer David Hollingsworth

Ottawa Personal Injury Lawyer David Hollingsworth, Ottawa Law Firms..It’s that time of year again- Holiday parties and family get togethers.  It is also the time of year when people are more social and therefore are sometimes drinking more.  One question I am often asked  as an Ontario personal injury lawyer concerns social host’s responsibility. Many people want to know if they are hosting a party what are they legally responsible for.  No one wants to think this way, but it is a reality. 

What are the legally responsable for  as a host of a party?
If someone attedns your party and becomes injured, the question will be whether the personal injuries suffered by the accident vicitms could have been reasonably foreseen by the host.  If the host did not know – nor ought to have known – that their guest was  intoxicated, then one can agree that they could not have known that htey were at risk of an injury.  This would mean the host of the party would not be responsible. In other words, as a host , you would hav eto prove that you  had no idea your guest was intoxicated.  This may be difficult to prove if you were serving alcohol.
When a host is aware their guest is intoxicated, the host may have the legal responsibility to ensure that their guest who is intoxicated not drive.  In other words, as a party host, when you know that a guest is intoxicated and intends to drive, STOP THEM.  Offer them a taxi home, find a designated driver to take them home or allow them to sleep over. You can also be held legally responsible if you continue to serve alcohol to an intoxicated guest knowing that they would be driving home. It’s not unlike when a bartender cuts off an intoxicated patron.

It’s common sense, you never want anyone being placed in a dangerous situation.  As a host you have the extra responsibility of ensuring that your guests depart safely and are free of injury.  Do whatever it takes….you will never regret airing on the side of being overly cautious …Happy holidays!

Every day, someone in Canada suffers a spinal cord injury (“SCI”). This is the sad but real reality of spinal cord injuries. They are happening all the time. More than 80,000 Canadians currently live with some form of Spinal Cord Injury. Sadly, this number is expected to climb. A report by the Urban Futures Institute estimates that roughly 86,000 individuals currently have spinal cord injuries in Canada. Tragically, this number is set to increase to 121,000 by 2030. That’s an increase of 35,000 in less than 19 years.  Too high a number, in my opinion because we should be learning how to better prevent such injuries from occurring. The statistics are grim. Roughly 48,243 people with SCI’s are fully paralyzed, while 30,324 can still make use of their arms. Individuals with SCI will spend an average 140 days in hospital, and will die 15 to 30 years earlier than the average person with an average life expectancy. That’s because victims of SCI are more susceptible to medical complications like urinary tract infections, pressure ulcers, pneumonia and mental illnesses such as depression and anxiety. Christopher Reeve, for example, is a tragic and iconic example of a SCI victim dying of the enumerated causes – namely, depression and pressure ulcers. It is ironic that even the invincible and iconic superman of our generation was not invincible enough to avoid a spinal cord injury. These injuries are serious and can happen to anyone.  So please take care and exercise caution in situations where you or your loved ones could be at risk.

Ontario car accidents and baby car seat installation tips, Ottawa Lawyer

Ottawa Lawyers, Ottawa InjuryLawyer David Hollingsworth. As a father of three young children who are all still in car seats, I found it  astonishing that 84 % of baby and infant car seats are not  properly installed.  This  leaves our children unsafe in the event of a car accident and more likely to suffer serious personal injury. It’s important to ensure your child is properly secured in their car seat to keep them safe. The following are a couple of things you can do help ensure your child’s safety in the event of a car accident:

Don’t buy a used car seat. A used car seat may have missing parts or was involved in a previous car accident. Older car seats also expire in 6-9 years. If you do however purchase a used car seat, please call the manufacturer to verify if it is still safe.

  1. 45 degree angle: Put rear-facing car seats at a 45-degree angle. At this angle, the baby’s head is supported and its chin won’t fall to the check, blocking your baby’s airway.
  2. Snap then Wrap: Cover your baby with blankets or dress him or her warmly if it is cold outside. But, beware bulky snowsuits will be compressed in a car crashor car accident, and the baby could be ejected from the car if the harness becomes loose. Dressing the baby warmly, and buckling in, then covering the baby with blankets for warmth is safer.
  3. Center Up: The best, safest location for your baby’s car seat is in the center seat. If you have multiple children, any back seat spot is safer than the front.
  4. Double Check: Use free installation checks performed by certified technicians, such as local Ottawa fire  stations or the Ottawa police.

And of course, ALWAYS drive safely !

Ottawa Bus Accident results in personal injuries, Ottawa lawyer David Hollingsworth

Ottawa Lawyer, Ottawa bus Accident Lawyer..Ottawa Fire crews extricated one person from a vehicle after it was involved in a T-bone bus accident with an OC Transpo bus in Ottawa’s east end last night. The Ottawa bus accident happened at Labelle and Michael streets just after 9:30 p.m. The Ottawa bus accident involved an OC Transpo bus and a four-door Pontiac Grand Prix. The Ottawa fire service said there were three people in the vehicle. Ottawa Paramedics transported three people to an Ottawa hospital. All suffered personal injuries. I hope everyone involved in this Ottawa accident is ok and their personal injuries heal fully and quickly.
