Ontario Spinal Cord Injury Lawyer, Ottawa Spinal Cord Injury Lawyer

Ontario Spinal Cord Injury Lawyers, Ottawa Spinal Cord Injury Lawyer David Hollingsworth..

Every day, someone in Canada suffers a spinal cord injury (“SCI”). This is the sad but real reality of spinal cord injuries. They are happening all the time. More than 80,000 Canadians currently live with some form of Spinal Cord Injury. Sadly, this number is expected to climb. A report by the Urban Futures Institute estimates that roughly 86,000 individuals currently have spinal cord injuries in Canada. Tragically, this number is set to increase to 121,000 by 2030. That’s an increase of 35,000 in less than 19 years.  Too high a number, in my opinion because we should be learning how to better prevent such injuries from occurring. The statistics are grim. Roughly 48,243 people with SCI’s are fully paralyzed, while 30,324 can still make use of their arms. Individuals with SCI will spend an average 140 days in hospital, and will die 15 to 30 years earlier than the average person with an average life expectancy. That’s because victims of SCI are more susceptible to medical complications like urinary tract infections, pressure ulcers, pneumonia and mental illnesses such as depression and anxiety. Christopher Reeve, for example, is a tragic and iconic example of a SCI victim dying of the enumerated causes – namely, depression and pressure ulcers. It is ironic that even the invincible and iconic superman of our generation was not invincible enough to avoid a spinal cord injury. These injuries are serious and can happen to anyone.  So please take care and exercise caution in situations where you or your loved ones could be at risk.

Ontario car accidents and baby car seat installation tips, Ottawa Lawyer

Ottawa Lawyers, Ottawa InjuryLawyer David Hollingsworth. As a father of three young children who are all still in car seats, I found it  astonishing that 84 % of baby and infant car seats are not  properly installed.  This  leaves our children unsafe in the event of a car accident and more likely to suffer serious personal injury. It’s important to ensure your child is properly secured in their car seat to keep them safe. The following are a couple of things you can do help ensure your child’s safety in the event of a car accident:

Don’t buy a used car seat. A used car seat may have missing parts or was involved in a previous car accident. Older car seats also expire in 6-9 years. If you do however purchase a used car seat, please call the manufacturer to verify if it is still safe.

  1. 45 degree angle: Put rear-facing car seats at a 45-degree angle. At this angle, the baby’s head is supported and its chin won’t fall to the check, blocking your baby’s airway.
  2. Snap then Wrap: Cover your baby with blankets or dress him or her warmly if it is cold outside. But, beware bulky snowsuits will be compressed in a car crashor car accident, and the baby could be ejected from the car if the harness becomes loose. Dressing the baby warmly, and buckling in, then covering the baby with blankets for warmth is safer.
  3. Center Up: The best, safest location for your baby’s car seat is in the center seat. If you have multiple children, any back seat spot is safer than the front.
  4. Double Check: Use free installation checks performed by certified technicians, such as local Ottawa fire  stations or the Ottawa police.

And of course, ALWAYS drive safely !

Prepare yourself for Ontario winter driving conditions, Ottawa Lawyer David Hollingsworth

Ottawa Accident Lawyers- Ottawa Law Firms- Law Firms in Ottawa, Ontario-  I came across this information on the Canadian Centre for Occupational Health and Safety website, found it useful and thought I would share it.  It serves as a good reminder for us all.  Be safe out there on the roads !!                           – David Hollingsworth, Ottawa Lawyer , specializing in personal injury

How should you prepare a vehicle for driving under winter conditions?Driving in winter weather — snow, ice, wet and cold — creates a great challenge for vehicles and drivers. Keeping your vehicle in good technical repair reduces your overall chances for any mishap or disaster while driving — particularly in winter weather. To prepare your vehicle for winter driving give it a complete checkup. Look for the following:

Electrical system

  • Battery — recharge or replace if the battery is weak. Also have the charging system checked.
  • Ignition — check for damaged ignition wires and cracks in the distributor cap.
  • Lights — check all lights (headlights, side lights, emergency flashers, directional lights, taillights, brake lights and parking lights) for proper functioning.

Brakes

  • Check brakes and adjust to ensure equal braking.

Tires

The traction between tires and roadway determines how well a vehicle rides, turns and stops, and is crucial for safe driving in winter. Proper tire selection is very important.

  • Use all-season radial tires only in areas that receive only light snowfall.
  • Use snow tires in areas that receive heavy snowfall.
  • Use chains on all four wheels when you expect severe snow and icy roads. Check with your local Department or Ministry of Transportation office to see if the use of tire chains is legal in the region through which you are planning to drive.
  • Check tire pressure and if necessary restore it to levels recommended by the tire manufacturer. The pressure drops about 1 psi for every 5°C (9°F) drop in temperature.
  • Do not mix radial tires with other types.
  • Check tire balance and correct if necessary.
  • Check wheel alignment and correct if necessary.

Exhaust system

  • Check the exhaust system for leaks. A properly sealed exhaust system reduces the risk for carbon monoxide poisoning.
  • Keep the window in your vehicle slightly open when you’re stuck in snow, and run the engine and heater to keep warm.
  • Keep the exhaust pipe clear of snow. A blocked pipe can force carbon monoxide back into the car interior.

Heating/cooling system

  • Check the radiator and hoses for leaks.
  • Ensure that your vehicle always has a sufficient amount of antifreeze rated for the coldest weather.
  • Check the defrosters (front and back) to make sure they are working efficiently.

Windshield wipers

  • Ensure that windshield wipers function efficiently. Replace them if they are old or worn.
  • Fill the washer container with an antifreeze fluid and top it up frequently.

Fuel

  • Fill up the fuel tank before you leave on your trip.
  • Do not let the fuel level get too low – the driving time to the next gas station may take much longer than you ever expected, and if you get stuck, the car engine will be your only source of heat.

What should I include in a winter driving kit?

A well-stocked winter driving kit helps to handle any emergency. It should include:

  • Properly fitting tire chains
  • Bag of sand or salt (or kitty litter)
  • Traction mats
  • Snow shovel
  • Snow brush
  • Ice scraper
  • Booster cables
  • Warning devices such as flares or emergency lights
  • Fuel line de-icer (methanol, also called methyl alcohol or methyl hydrate)
  • Extra windshield wiper fluid appropriate for sub-freezing temperatures
  • Roll of paper towels
  • Flashlight and a portable flashing light (and extra batteries)
  • Blanket
  • Extra clothing, including hat and wind-proof pants, and warm footwear
  • First aid kit
  • Snack bars or other “emergency” food and water
  • Matches and emergency candles – only use with a window opened to prevent build-up of carbon monoxide.
  • Road maps.
  • “Call Police” or other help signs or brightly coloured banners.

How should you prepare yourself for winter driving?

  • Plan your driving in advance.
  • Avoid driving when fatigued.
  • Contact your provincial “Road Reports” to get updates regarding road conditions in the region to which you are going.
  • Check weather conditions for your travel route (and time) before you begin driving.
  • Plan your arrival time at a destination by taking into account any delays due to slower traffic, reduced visibility, roadblocks, abandoned automobiles, collisions, etc.
  • Inform someone of your route and planned arrival time.
  • Choose warm and comfortable clothing. If you need to remove outdoor clothing later while driving, STOP the vehicle in a safe spot.
  • Warm up your vehicle BEFORE driving off. It reduces moisture condensing on the inside of the windows.
  • NEVER warm up your vehicle in a closed garage.
  • Remove snow and ice from your vehicle. It helps to see and, equally important, to be seen.
  • Wear sunglasses on bright sunny days.
  • Bring a cell phone if you have one but do not leave it in the car as the battery will freeze.

How should you drive in winter weather?

  • Buckle up before you start driving. Keep your seat belt buckled at all times.
  • SLOW DOWN! - posted speed limits are for ideal travel conditions. Driving at reduced speeds is the best precautionary measure against any misfortune while driving on slippery roads. “Black ice” is invisible.
  • Be alert. Black ice will make a road look like shiney new asphalt. Pavement should look grey-white in winter.
  • Do not use cruise control. Winter driving requires you to be in full control at all times.
  • Reduce your speed while approaching intersections covered with ice or snow.
  • Allow for extra travelling time or even consider delaying a trip if the weather is inclement.
  • Drive with low-beam headlights on. Not only are they brighter than daytime running lights but turning them on also activates the tail lights. This makes your vehicle more visible.
  • Lengthen your following distance behind the vehicle ahead of you. Stopping distance on an icy road is double that of stopping on a dry one. For example, from around 45 meters (140 ft) at the speed of 60 km/h, to 80 meters (over 260 ft) on an icy road surface.
  • Stay in the right-hand lane except when passing and use turn signals when changing lanes.
  • Steer with smooth and precise movements. Changing lanes too quickly and jerky steering while braking or accelerating can cause skidding.
  • Be aware and slow down when you see a sign warning that you are approaching a bridge. Steel and concrete bridges are likely to be icy even when there is no ice on the asphalt surface, (because bridges over open air cool down faster than roads which tend to be insulated somewhat by solid ground.)
  • Consider getting off the road before getting stranded if the weather is worsening.
  • Be patient and pass other cars only when it is safe to do so.

Peter Vatcher Car Accident results in serious personal injury, Ottawa lawyer David Hollingsworth

Ottawa Lawyers, Ottawa Law Firm David Hollingsworth…I am sorry to everyone involved in this Ottawa accident.  The survivor of this Ottawa car accident Peter Vatcher, luckily excercised his good driving skills and consequently saved his own life.  This Ottawa accident could have easily taken more lives. The past four days have been an emotional rollercoaster for Peter Vatcher, 43, who was nearly killed in a fatal crash just south of Ottawa last week, said his wife Jane, 48. “He feels a lot of remorse for taking the life of somebody, although he finally realizes it wasn’t his fault,” she said.

Two men — Tim Helmer, 43, and James Taylor, 38 — were killed in the crash, which happened on Bank Street near Greely on Thursday evening. Helmer and Taylor were in a Ford van travelling southbound when they tried to pass the vehicle in front, lost control and struck by a Ford Escape SUV travelling northbound.

Vatcher, who was driving the SUV, is in stable condition at the Ottawa Hospital’s civic campus after suffering serious injuries. He went for surgery and had a pin put into his left arm on Friday. Vatcher also had cracked ribs, cuts on his head, stitches on his leg and bruises all over his body. Thankfully, his wife Jane has been spending each day with him, caring for him as he did for her when she was in hospital earlier this year after sustaining snowmobile injuries.

“It’s been very long days, but I wouldn’t be anywhere else,” Jane said. The two have been married for 19 years. Their daughters, Stephanie, 18, and Gillian, 17, have been visiting their father each day. “They’re handling it, they have moments when it’s a little more tough.” The night of the accident, Vatcher was on his way home after having bought eight winter tires for his wife’s van and his daughter’s car. He has been a UPS driver for 15 years and was on the company’s committee for safe driving. This might have been what saved him, said Jane.

Police have said the driver of the SUV, Vatcher, was not drinking or speeding and was wearing a seatbelt. The two men who were killed were not wearing seatbelts. Speed and alcohol might have been factors in the accident, police said.

Vatcher probably won’t be able to return to work for at least four or five months, Jane said, adding that while she is caring for her husband, she will put aside her job hunt. She lost her job in May 2009 and had already put the hunt on hold once before while she was in hospital.

She said the family is working to get through this and they sympathize with the families of the two men who died. “It’s a sad time for everybody, but it’s overwhelming the support we’re getting,” she said. “We’re still here, we’re still together and he’s going to recover.”

This type of positive attitude will take this family a long way !!

Meanwhile, sadly, the mother of one of the men who died described her son as a “good guy.” “(Tim) was a good person, he went to work everyday,” said Margaret Helmer, who lives in Winchester. She said her son worked for Grandor Group, a lumber supplier in the region.

I am also sorry for the loss of Tim and my condolences go out to his friends and family…

Helmer lived with his common law wife, Tracie Baker, 42, just outside Ottawa. His 24-year-old son, Tyler, and his two grandchildren live in Greely. “(Tim) liked to watch hockey and football,” said Margaret. “He was my baby.”

Navan Accident ends in death, Ottawa Lawyers, Ottawa Law Firms

Tragically, a 31-year-old Navan woman was killed Wednesday morning after being hit by a dump truck on Navan Road near Orleans Boulevard. Police closed Navan Road for several hours between Pagé Road and Orleans Boulevard while they investigated the accident, which happened about 9:20 a.m. close to an OC Transpo bus stop near 2878 Navan Rd. Insp. John Maxwell said the woman had just got off the bus at the bus stop and was trying to cross Navan Road, likely heading home, when she was struck. Paramedic spokesman J.P. Trottier said the woman had no vital signs when paramedics arrived and they immediately began trying to resuscitate her, both at the scene and en route to hospital. Trottier said she suffered critical head injuries and fractures to her legs and one arm. Two blue and white BFI Canada dump trucks were pulled over at the scene, a pair of black sandals lying on the road between them. At about 10:30 a.m. investigators in neon green vests spoke with the male driver of one of the trucks. About the same time, two BFI staff arrived but had no comment, saying they didn’t know anything yet. Neighbour Auguste Gauthier said people speed on the 70-kilometre-per-hour road all the time. ”It’s ridiculous. It was going to happen. It’s going to happen again if they don’t do something,” he said..

Ottawa Car Accident Statistics, Ottawa Accident Rate High for 2010

Ottawa Personal Injury Lawyer David Hollingsworth, Ontario Car Accident Lawyer…So far in 2010, people have died in 22 motor vehicle accidents in the Ottawa area. That’s roughly the same number of fatalities in each of 2008 and 2009. As well, almost all of this year’s fatal collisions have happened in the spring and summer. There were two in January, then none until April 11.

Three fatal hit-and-runs occurred within 90 minutes of Ottawa on the evening of Sept. 9, 2010. A 16-year-old biking home from work in Greely, a 63-year-old woman out for her daily walk in a village west of Gracefield, Que. and a 54-year-old man riding his scooter near Brockville were killed.

There seems to be no explanation for the unusually high number of fatal collisions.

Investigations into a number of high profile collisions — such as the motorcycle accident that took the life of senior Liberal communications aide Mario Laguë, a student driver who was involved in a collision with a cyclist who was pinned and dragged under her SUV, and the crash that landed Senators team doctor Donald Chow in hospital in critical condition – have gone weeks without updates..

New York-based traffic expert Sam Schwartz said fatal collisions are up worldwide this year as economies recover from the recession and more people can afford to drive. With no patterns, links or explanation for the high number of fatal collisions, there’s no way to know how high the toll might climb, but even a few more fatal crashes will make the tally for 2010 significantly higher than the past two years.

We’re at the middle of September and Ottawa car accidents are already at the level they were at for the previous two years. And we’ve still got the rest of 2010 to go…Ottawa accidents have also resulted in a bad year for fatalities

2008 20 23

2009 22 25

2010 (so far) 22 24

As an Ottawa personal injury lawyer, I too have seen an increase in the the number of accident Ottawa accident victims that need my help.  As an Ottawa personal injury lawyer and an Ontario personal injury lawyer, I have some very serious concerns about the changes the Ontario government announced with the new regulations for auto insurance in Ontario, specifically the reduction of medical and rehabilitations expenses from $100,000 to $50,000. This reduction in medical and rehabilitation expenses will have a significant impact on accident victims in Ottawa and  Ontario. Unfortunately it will have a tremendous impact on Ottawa accident victims who are seriously injured but not necessarily catastrophically injured. In this case the medical rehabilitation benefits may run out before they can apply for catastrophic benefits at two years. What is equally disturbing about the proposed changes is that many accident victims who by the time of their injury have a psychological component, (ie: psych treatment, physio treatment, occupational therapy treatment, or home modifications) will be in need of more. Home modifications for example, building a ramp to your front door, or modifying your washroom to accommodate your disability or get a stair lift, all of these things come out of this settlement . In other words , a small amount of money over a ten year period just won’t go that far and won’t be enough ! In addition to the reduction in available benefits, the new regulations also affect assessments. In addition to reducing the amount of medical and rehab expenses, the propsed changes want to have the cost of insurer assessments in the victim’s settlement.
More importantly than ever, my role as an Ottawa personal injury lawyer and Ontario personal injury lawyer willl be critical in obtaining maximum compensation for Ontario accident victims.  I am  dedicated to this and offer  free consultations and make  home visits or hospital visits. Ottawa Car Accident Ottawa River Parkway, Ottawa Lawyers David Hollingswoth

Ottawa Car Accident Lawyer, Personal Injury Attorney David Hollingsworth…I am sorry to update this with a report of more serious injury to one of the Ottawa accident victims.  He is fighting for his life with critical personal injuries.  I will be thinking of him and his family and hope to soon report better news… Regrettably, 2 young men were rushed to an Ottawa hospital after an early morning crash this morning on the Ottawa River Parkway. Ottawa Police  reported two men were travelling in a car on the Ottawa Parkway at about 3 a.m. when the driver lost control and hit a tree near Goldenrod Street. Ottawa Firefighters took over 1/2 an hour to remove the passenger from the vehicle. The driver was walking outside the car when fire services arrived. Both young men — one aged 19, the other 20 — were taken to an Ottawa hospital. Police were unable to provide detail as to their condition. Their names were not being released. Ottawa Parkway’s eastbound lanes remains closed from Island Park Drive to Parkdale Avenue. People walking or cycling near the area are being kept away from the Ottawa accident scene. The RCMP, who have jurisdiction on the Ottawa Parkway, are investigating with the assistance of the Ottawa Police  collision team.

update:

A 19-year-old male trapped in a vehicle for an hour following a serious collision on the Ottawa River Parkway early Sunday morning is in hospital with critical injuries, fighting for his life. The incident took place around 3:15 a.m. in the eastbound lanes, west of parkdale avenue, when a vehicle left the road and crashed into a large tree. Paramedics reported the Acura Integra had “a devastating amount of damage”. The driver, who is in his 20s, had a moderate back injury and was walking around when paramedics came to the scene. He is in stable condition in an Ottawa hospital. It took emergency officials an hour to free the one passenger in the vehicle, stuck in the front seat. He had major injuries to his head, chest and abdomen and is now at the Ottawa Hospital Trauma Unit.
