Ontario accident benefits and indexation. Should you purchase additional accident benefits?
Ottawa Insurance Claims Lawyers David Hollingsworth and Associates. In September 2010, The Ontario government through the Financial Services Commission of Ontario made significant changes to Ontario insurance plans. Not only did FSCO significantly reduce the accident benefits available to Ontario drivers, it introduced a 2 tiered approach for Ontario drivers. All Ontario drivers are required to purchase insurance. How much insurance you purchase is up to you. There are several “top ups” that can be purchased in the event that you or a loved one is in an accident in Ontario. Indexation is an additional Ontario accident benefit that can be purchased. This optional benefit provides for an automatic adjustment over time of several different accident benefits including income replacement benefits, medical and rehabilitation benefits, attendant care benefits and other Ontario accident benefits. The indexation of these accident benefits is determined by the changes in inflation based on Consumer Price Index of Canada. Basically, it’s an extra insurance policy that ensures that your benefit dollars keep up with the times.
In other words, a dollar today is not going to be worth what a dollar tomorrow will be worth. As an Ottawa personal injury lawyer, I know how important Ontario accident benefits are to my clients. Often times, people are unable to return to their previous life before the accident and are left with their insurance claim and accident benefits to carry them throughout the rest of their lives. I know that Ontario insurance premiums are already very high, so paying even more is frustrating; however, if ever you need to access these accident benefits, you will need them.
Something to think about…

Personal Injury Lawyers Ottawa Ontario…update…Colin Geddis, 21 and Jasmine Morris, 26 have been identified as the deceased accident victims
original post: Sadly, 2 people have died after a terrible accident in North Glengarry Township. For unknown reasons, their vehicle left McCormick Road around 1 a.m. Sunday for unknown reasons, drove into a ditch and hit a tree. Inside the vehicle was a 21 year old man, along with a 26 year old woman . Sadly, they were both pronounced dead at the accident scene. The driver of the vehicle was a 25 year old male. He was airlifted to the Ottawa Hospital Civic Campus with serious personal injuries. My thoughts go out to the Geddis and Morris families at this very difficult time. I’m sorry for their losses and I hope that the driver is able to pull through.

Ottawa Accident Lawyer : Ottawa Police Aim to Reduce Ottawa Car Accidents
Posted by Ottawa Personal Injury Lawyer, Ottawa Accident Lawyer, David Hollingsworth in Ottawa Car Accidents, Ottawa Injury and Accidents, Ottawa Resources on January 5th, 2011
Ottawa Accident Lawyer David Hollingsworth….The City of Ottawa’s Selective Traffic Enforcement Program (STEP) is ringing in the New Year with a crackdown on tailgaters and stop sign runners. In 2009, tailgating caused 4,973 rear-end collisions – the most frequent type of Ottawa accidents accounting for 1/3 of Ottawa’s total car accidents. These Ottawa accidents resulted in one death and 1,373 personal injuries – 17 of them life-threatening personal injuries. Disobeying stop signs – including rolling stops – is also a serious issue on Ottawa roads. In 2009, 1,667 accidents at stop sign-controlled intersections resulted in one death and 462 personal injuries – 17 of them life-threatening personal injuries. Each month since 2004, STEP has been profiling and enforcing two initiatives that target specific traffic safety priorities. These initiatives support the City’s larger Integrated Road Safety Program (IRSP) public awareness and enforcement campaigns. In 2003, two City departments – Public Works and Ottawa Public Health – and the Ottawa Police Service developed the IRSP to provide a comprehensive approach in promoting road safety. Ottawa residents have identified traffic safety as a top priority. The IRSP is committed to using available resources to make Ottawa roads safer for residents.

Ottawa Accident-Serious Personal Injury- Bankfield Road, Highway 416
Posted by Ottawa Personal Injury Lawyer, Ottawa Accident Lawyer, David Hollingsworth in Ottawa Injury and Accidents on December 13th, 2010
OTTAWA accident lawyers, Ottawa Lawyer - Ottawa Police reopened Bankfield Road from Highway 416 to William McEwen Drive around 6 p.m. Friday after a late afternoon Ottawa car accident that sent 4 people to an Ottawa hospital, including two with serious injuries and forced the closure of the stretch of road. Ottawa Police said two motor vehicles collided at around 3:30 p.m. Ottawa firefighters removed the front doors and the roof of the car to get three Ottawa accident victims out. The driver, a woman, suffered the worst personal injuries and was airlifted to an Ottawa hospital. Two other car occupants, a man and a woman, were also taken to an Ottawa hospital by Ottawa ambulance. So, too, was the driver of the minivan, although his injuries, like those of the two car occupants, were described as having non-life threatening. I send out good thoughts of full and speedy recoveries to everyone involved in this Ottawa accident. I hope everyone involved is and will be allright. Ottawa roads were very slick this weekend and it looks like they may continue to be so for the next couple of days. Drive safely out there. -Ottawa Car Accident Lawyer David Hollingsworth

Ottawa’s west end car accident- woman and baby taken to Ottawa hospital
Posted by Ottawa Personal Injury Lawyer, Ottawa Accident Lawyer, David Hollingsworth in Ottawa Injury and Accidents on October 13th, 2010
Ottawa Personal Injury Lawyers, Ottawa Law Firms, Lawyers in Ottawa..David Hollingsworth… Thankfully the baby in this Ottawa accident is ok, and the mother of the baby and the driver of the other car were taken to an Ottawa hospital. The baby was also taken to an Ottawa hospital as a precaution.
The intersection of Meadowlands Drive and Merivale Road was closed yesterday morning after a 9:30 a.m. multi-vehicle collision. Ottawa paramedics said two vehicles involved were heavily damaged. A 74-year-old woman was found without vital signs but regained a pulse en route to hospital after aggressive resuscitation measures by paramedics and firefighters. Fire department spokesman Marc Messier said firefighters were performing CPR on the woman while paramedics were busy assisting other injured patients when they first arrived at the scene. One of the firefighters rode in the ambulance with paramedics once they took over her care. She was stabilized prior to arrival at an Ottawa hospital. Terri Huard was heading west on Meadowlands and was stopped at a red light at Merivale when she saw a white car begin to swerve. Huard thought the car was trying to do a U-turn until she noticed the elderly woman driving had her head down. The car hit a Purolator truck before hitting a van carrying a mother and her nine-month-old child. The front of the white car was demolished.
“Thank God we had a red light because we would have been killed,” she said. “She would have hit us head on.” A 34-year-old woman was treated for neck and arm pain, and that woman’s nine-month-old child was taken to an hospital thankfully, as a precaution. The driver of the Purolator vehicle involved in the accident rescued the child from the woman’s vehicle.

Ottawa Accident March Road Results with Young Girl Critical Personal Injuries
Posted by Ottawa Personal Injury Lawyer, Ottawa Accident Lawyer, David Hollingsworth in Ottawa Car Accidents, Ottawa Injury and Accidents on August 15th, 2010
Ottawa Accident Lawyer David Hollingsworth..Regrettably, I am reporting that a young girl remains at CHEO tonight with very serious, life threatening personal injury as a result of an Ottawa accident earlier this morning. My thoughts are with her family and friends at this very difficult time. Ottawa police have pleaded to the Ottawa commmunity for help in trying to figure out what happenned to this young girl. A 16 year old girl has been taken to hospital with life-threatening personal injuries after an accident at March Road near Highway 417 Sunday morning. Police said the 17-year-old was a passenger in a vehicle, whose driver lost control and hit a tree in the area of March and Thomas Argue roads at about 1:25 a.m. Thankfully, 3 other passengers, did not suffer personal injury. The young girl was airlifted to CHEO where she remains in critical condition. My thoughts go out to her and I hope to soon report of her full recovery.
update:
OTTAWA — A 17-year-old male has been charged with careless driving and driving with a blood alcohol level above zero after a car crashed into tree Sunday morning, police said. A 17-year-old girl was taken to hospital with life-threatening injuries after an accident at March Road near Highway 417 around 1:25 a.m. She was airlifted to CHEO in critical condition.
I am relieved to report that this young girl’s condition has improved; although she still has a long way to go…Police said her condition has been downgraded from life-threatening to stable condition.
Police have charged the 17-year-old driver with careless driving under the Highway Traffic Act. The youth was also charged with driving with a blood alcohol level above zero. New legislation, which came into effect in July, requires young drivers to be alcohol-free when they get behind the wheel.

Ottawa slip and fall accident ? Ottawa lawyer David Hollingsworth-questions..
Posted by Ottawa Personal Injury Lawyer, Ottawa Accident Lawyer, David Hollingsworth in Ottawa Injury and Accidents, Personal Injury Claims, safety on January 27th, 2010
Ottawa Ontario slip and fall lawyer David Hollingsworth explains the dangers and factors involved in a slip and fall accident in Ontario.
With respect to compensation, a slip and fall victim’s eligibility will vary depending on the circumstances of the injury but overall, the fall accident will be similar to all Ontario personal injury claims. Namely, this means that your recovery may account for medical bills, wage loss, pain and suffering, and your potential for future medical expenses.
You are generally advised to visit a top Ottawa slip and fall lawyer such as David Hollingsworth as soon as possible after your injury to avoid limitations periods and the chance to secure and protect your interests. Similarly, you are advised to meet with a lawyer before meeting with an insurance adjuster, who may wish to settle quickly and for less than you deserve. Such adjuster’s attempt to establish if there was an injury, your role if any in the injury, and any prospective settlement that could be procured, often immediately. Questions from such adjusters can be very specific and it is best to speak with a lawyer such as David Hollingsworth to protect and safeguard your interests before signing any document. You do not want to lose out on what you deserve.
The responsibility for the injury can depend on the situation of your fall, and the idea of a “hazardous condition”, which relates to the situational potential for personal injury. Hazardous conditions can be temporary (such as the integrity of an easement or ice on a sidewalk), or permanent (property owners are held liable for permanent conditions since they are expected to have knowledge about their nature). The nature of your injury and the context of the slip and fall will determine who is responsible, whether it may be a property owner, a commercial enterprise, or some other individual. The key is to visit someone who is competent and experienced in dealing with such matters, as soon as possible so that valuable evidence is not lost and your position is secured to advance your claims so that you may receive the maximum possible compensation and support for your injury.
People claim slip and fall accident injury compensation each week. If you suffer from a personal injury due to a slip and fall accident, you need compensation and you owe it to yourself to see just how much you might be entitled to receive.
