What are Ontario Accident Benefits ? Are family members entitled to accident benefits?

Statutory Accident Benefits (SABS) are provided by law in every Ontario auto insurance policy. All Accident Benefits are standard and equal among insurance companies, unless you opt for “top up” coverage. Ontario  Accident Benefits provide compensation, regardless of who is at fault, for drivers, passengers, pedestrians and family members who suffer personal injury or death caused by an accident in Ontario or any accident if you are a resident in Ontario. The following accident benefits are the standard Ontario Accident Benefits and are available to most accident victims in Ontario:
  • Income Replacement: Just like it says…the income replacement benefit compensates  for lost income/wages.
  • Non-earner benefit: The non-earner benefit applies when you are unable to carry on a “normal life” and do not qualify for either an Income Replacement benefit or Caregiver benefit.
  • Caregiver benefits: Compensation for expenses incurred when a member of your home needs care and someone is hired to care for them because you no longer can.
  • Medical benefits: Covers medical expenses that occurred as a result of the injury.
  • Rehabilitation benefits: Covers rehabilitation expenses incurred as a result of an injury.
  • Attendant Care benefits: Covers some of the expense incurred by hiring an aide or attendant.
  • Compensation for Other Expenses: These accident benefits pay for some expenses such as monies put out by family members costs in being with you during visitation and recovery. Often times some housekeeping and home maintenance is also covered , as well as lost or damaged articles during accident. ie: computer in car etc…
  • Death benefits: Family members may collect this accident benefit on behalf of a deceased family member.
  • Funeral benefits: These accident benefits help cover funeral expenses.

Ontario insurance accident benefits claims: Can a relative make a claim on my insurance?

First and foremost, if needed seek medical attention immediately and ensure that your health needs are being met.

Within 7 days of your accident, it is crucial…
That you or a loved one notifies your insurance company of  the accident.

Within 30 Days of your accident, it is crucial…
That you make an application for accident benefits.

Within 2 Years of your accident, it is crucial…

Ontario cyclists and accident benefits insurance compensation. You may be entitled !

Did you know that as a cyclists you are entitled to Ontario accident benefits coverage ?  Your own auto insurance, may cover your physiotherapy, your income loss, pain and suffering, attendant care, rehabilitation or any other costs associated with your injuries as the result of a cycling accident. If in an Ontario accident, do you have to provide your insurance information ?

Section 200 of the Highway Traffic Act states that any person involved in an Ontario accident must, when requested, must provide his/her name, address, driver’s licence number, insurance policy information and ownership information.  This information must also be given to the police and to all witnesses or anyone else who may have been involved in the Ontario accident. Failure to comply with section 200 means that they are guilty of an offence.  On conviction , they can be fined or even imprisoned or have their licence suspended.

What you should do if someone refuses to give you their information.

Should someone refuse to give you their information, try to get as much information as possible and contact the police as soon as possible.   If the driver was uninsured , the police will have access to this type of information. Most likely, the police will charge the other driver.  In terms of Accident Benefits, you will still be covered by your own insurance company, so do not worry.

Embrun accident sends 18 year old to hospital in critical condition

Ontario Injury Lawyer David Hollingsworth ..Metcalfe Accident…Sadly, an 18-year-old Metcalfe woman remains in critical condition after a terrible accident occurred when her car hit a tree in Embrun early Tuesday morning, close to Notre-Dame Street at about  1:45 a.m. Anyone who may have information related to this accident are asked to contact the Ontario Provincial Police…     My thoughts are with this young girl’s family and friends at this very stressful time….

Bells Corners Ottawa accident, toddler rushed to CHEO with life threatening injury.

Ottawa Injury Lawyer David Hollingsworth…A terrible Ottawa accident resulted in a 2 1/2 year old girl being rushed to the Queensway Carleton Hospital  in critical condition after she was hit in Ottawa east  end by a minivan on Cymbeline Drive. She was later transferred to CHEO. Ottawa Police arrived around 2:30 p.m. to the accident scene in the 0 to 100 block of Cymbeline Drive, in Bells Corners, close to the intersection of Moodie Drive and Robertson Road. The toddler had been walking with her mother, who was pushing a stroller,  when she was struck. The toddler was unconscious when rescue crews arrived and had life-threatening head injury, chest injury , leg injury and severe internal injuries. Ottawa Police are still investigating this terrible Ottawa accident . My thoughts go out to this family at this terribly difficult time.  My thoughts are with this little girl and her FULL recovery.  I’m also thinking of her parents at this time.  … As a father of three young children myself, I am her sending her hope and strength…

Ottawa Police aiming to reduce Ottawa cycling accidents with cycling safety

Ottawa Personal Injury Lawyer David Hollingsworth ..Ottawa Police are conducting a bicycle safety campaign until this Sunday to ensure Ottawa cyclists are adhering to all road safety rules. For everyone’s safety , Ottawa Cyclists are reminded to stop at all stop signs and red lights.  Ottawa Police are also cautioning Ottawa cyclists to be careful when crossing intersections and to use proper cycling hand signals when turning and stopping.  It is illegal for cyclists to ride on the sidewalk, and cyclists must share the road.

Please everyone–drivers and cyclists, be very careful and aware of each other out on our Ottawa roads.

Ottawa motorcycle accident : man rushed to Ottawa hospital in critical condition

Ottawa Injury Lawyers David Hollingsworth…Sadly, an Ottawa  man in his 30s is in critical condition after a serious motorcycle accident , when he hit a  guardrail in Ottawa’s east end yesterday afternoon. Ottawa rescue services arrived  to Highway 174′s east off-ramp on Blair Road, shortly after 2:00 in the afternoon. The man had suffered serious personal injuries  to his chest and limbs and was rushed to an Ottawa hospital in critical condition. Ottawa police are continuing to investigate. My thoughts are with this man, his friends and family and I hope his condition improves significantly today…

Belleville Ontario Accident results in death of crossing guard Norman Cole.

Ontario Injury Lawyer David Hollingsworth…Belleville Ontario police need our help and are looking for any witnesses who may have information about an accident where a crossing guard was struck and died   on Friday. Sadly, 71 year old Norman Cole was hit by a vehicle at the intersection of Sidney Street and Leland Drive, west of downtown Belleville.
