  • What is considered tailgating?

    What is a safe distance to travel behind other vehicles to avoid an Ottawa accident? Apply the two-second rule. It is the same method that is outlined in the Ontario Ministry of Transportation’s Driver’s Handbook. Use this test while driving.

    • Choose an object ahead of you on the road to use as a reference point– EX: road sign, pole or tree
    • Once the back-end of the vehicle ahead of you passes the reference point, start counting using steamboats.
    • Count how long it takes the front of your vehicle to reach the same reference point.
    • If it takes less than two seconds (or steamboats), you’re travelling too close and are risking an Ottawa accident.
      Important: In wet or slippery conditions, you should allow even more time. Allow yourself time to react and stop quickly and avoid an accident and serious personal injuries.

    Ottawa Lawyers: Ottawa Police aim to reduce Ottawa accidents by targeting stop sign runners and speeding.

    Ottawa Lawyers David Hollingsworth, Ottawa Law Firms….Ottawa Police will have stop sign runners and motorists who speed in construction zones on their radar during the Ottawa’s Selective Traffic Enforcement Program (STEP) this month. Disobeying stop signs – including rolling stops – is a serious issue on Ottawa roads and can contribute to the risk of Ottawa accidents.  In 2009, 1,667 Ottawa collisions at stop sign-controlled intersections resulted in one death and 462 personal injuries – 17 of them life-threatening and critical personal injuries. As for speeding in Ottawa construction zones, provincial legislation allows for the doubling of fines for Ontario motorists caught exceeding posted speed limits in construction zones when workers are present.  Ottawa Police will be applying this legislation with a zero tolerance approach this month. In Ottawa, between 2007 and 2009, 526 Ottawa accidents occurred in construction zones resulting in 114 personal injuries, eight of which were serious personal injuries.  One construction worker was actually struck and injured on the job by a motorist. In 2003, Public Works and Ottawa Public Health – and the Ottawa Police Service developed the IRSP to provide a comprehensive approach in promoting road safety in Ottawa.

These Ottawa accidents resulted in one death and 1,373 personal injuries – 17 of them life-threatening personal injuries.  Disobeying stop signs – including rolling stops – is also a serious issue on Ottawa roads. In 2009, 1,667 accidents at stop sign-controlled intersections resulted in one death and 462 personal injuries – 17 of them life-threatening personal injuries. Each month since 2004, STEP has been profiling and enforcing two initiatives that target specific traffic safety priorities. These initiatives support the City’s larger Integrated Road Safety Program (IRSP) public awareness and enforcement campaigns.  In 2003, two City departments – Public Works and Ottawa Public Health – and the Ottawa Police Service developed the IRSP to provide a comprehensive approach in promoting road safety.  Ottawa residents have identified traffic safety as a top priority. The IRSP is committed to using available resources to make Ottawa roads safer for residents.

Unfortunately 2010 has been a year in which Ottawa fatal accidents were statistically high. Ottawa police are increasing their presence on the streets during the holiday season.

    Social Host Liability..Do whatever it takes to keep your guests safe..Ottawa lawyer David Hollingsworth

    Ottawa Personal Injury Lawyer David Hollingsworth, Ottawa Law Firms..It’s that time of year again- Holiday parties and family get togethers.  It is also the time of year when people are more social and therefore are sometimes drinking more.  One question I am often asked  as an Ontario personal injury lawyer concerns social host’s responsibility. Many people want to know if they are hosting a party what are they legally responsible for.  No one wants to think this way, but it is a reality. 

    What are the legally responsable for  as a host of a party?
    If someone attedns your party and becomes injured, the question will be whether the personal injuries suffered by the accident vicitms could have been reasonably foreseen by the host.  If the host did not know – nor ought to have known – that their guest was  intoxicated, then one can agree that they could not have known that htey were at risk of an injury.  This would mean the host of the party would not be responsible. In other words, as a host , you would hav eto prove that you  had no idea your guest was intoxicated.  This may be difficult to prove if you were serving alcohol.
    When a host is aware their guest is intoxicated, the host may have the legal responsibility to ensure that their guest who is intoxicated not drive.  In other words, as a party host, when you know that a guest is intoxicated and intends to drive, STOP THEM.  Offer them a taxi home, find a designated driver to take them home or allow them to sleep over. You can also be held legally responsible if you continue to serve alcohol to an intoxicated guest knowing that they would be driving home. It’s not unlike when a bartender cuts off an intoxicated patron.

    It’s common sense, you never want anyone being placed in a dangerous situation.  As a host you have the extra responsibility of ensuring that your guests depart safely and are free of injury.  Do whatever it takes….you will never regret airing on the side of being overly cautious …Happy holidays!

    Tips for staying safe at an Ottawa accident scene. Ottawa lawyer , Ottawa law firms

    While most major roadways have now been salted, Ottawa roads remain a challenge. There were many Ottawa accidents this morning and late last night due to the freezing rain and Ottawa residents are being asked to take it slow after a spat of freezing rain overnight created large swaths of black ice throughout the city and a deluge of crashes. Ottawa Police were urging caution last night and this morning after a rush of collisions last night,  involving Ottawa paramedics who were busy assessing patients at Ottawa accident scenes. Much of the action was taking place on Highway 417  last night. For a period of about 30 minutes, Ottawa paramedics said they received multiple calls for Ottawa accident between Woodroffe Avenue to the west and Nicholas Street to the east. And in responding to two of those calls — despite the 30 bright LED emergency lights flashing on each of their vehicles — other motorists on the highway managed to slam into them, causing personal injuries and “severe damage” to the vehicles involved. Four Ottawa paramedics were injured and forced to fall out of Sunday night’s busy rotation after two ambulances were rear-ended. The first occurred at about 10:15 p.m. when a black Chevrolet Blazer rear-ended an ambulance in the westbound lanes with all of its emergency lights flashing, paramedics said. The lone driver of the Blazer refused to be treated by paramedics, while two paramedics were treated for personal injuries by another crew. One minute later, a paramedic superintendent of operations issued a warning to all paramedics on the road to be wary of inattentive drivers in the rapidly deteriorating road conditions. Salt trucks were also called upon for problem spots on the 417. Five minutes after that, at 10:20 p.m., a two-vehicle crash near the eastbound Nicholas Street exit quickly snared 11 drivers, paramedics said. For the safety of the injured, all patients were taken to the Sandy Hill Arena for assessment. Of them, one was taken to the Children’s Hospital of Eastern Ontario and all others were released. A third collision on the 417 was reported at 10:45 p.m. just west of Woodroffe Avenue in the eastbound lanes. Paramedics said a Honda Civic travelling too fast for icy conditions rear-ended yet another ambulance with its emergency lights flashing. The Civic sustained severe damage to its front end but its driver refused treatment. Two paramedics, meanwhile, were treated for back injuries by a second crew. Startlingly, paramedics said a nearby Ontario Provincial Police cruiser was registering speeds by passing motorists at 115 kilometres per hour. By Monday morning at about 8 a.m., paramedics said they had so far responded to an estimated 20 collisions, the majority of them minor in nature.

    Tips for staying safe at an Ottawa accident scene 

    After the onslaught of activity, Ottawa paramedics were taking the opportunity to remind drivers about Ottawa wintertime safety in the event of an accident. They said to stay inside your vehicle — which is designed with a safety cage — at all times to avoid being swiped by other vehicles. They also said that if you see flashing lights at some kind of scene up ahead, it’s likely because the conditions there are worse. Slow down, pass with caution, be aware that paramedics working the scene are often concealed by large vehicles, and leave plenty of room by moving over at least one full lane away from the scene.
