Ottawa’s icy road conditions lead to over 70 Ottawa accidents
Ottawa Personal Injury Lawyer David Hollingsworth — Yesterday’s icy weather conditions caused a tractor-trailer to hit 3 vehicles on Greenbank Road between Fallowfield and West Hunt Club roads. As a result of the Ottawa accident, one person was trapped in a vehicle and 3 others suffered serious personal injury.
There were more than 70 Ottawa accidents on Ottawa’s icy roads yesterday according to Ottawa police. The Ottawa Paramedic Service said that Ottawa accidents were “starting to pile up” as Ottawa received 10 to 15 millimetres of freezing rain.
Emergency crews on the Ottawa accident scene at the Greenbank accident were able to extricate the trapped occupant from the vehicle without the need for heavy equipment. Greenbank Road was closed for about two hours. Ottawa Paramedics say 2 people in their 50s suffered neck and back injury. Thankfully, they are in stable condition in an Ottawa hospital.
Ottawa Emergency crews also responded to 25 injuries from slips and falls on slippery Ottawa roads and sidewalks.

ENDORSEMENT
[1] Lanark Mutual Insurance Company appeals a judgment that requires it to defend and indemnify the respondents in a tort action brought by their daughter, Naomi Marchand, who fell off the balcony of their home and was seriously injured.
[2]The issue is whether Naomi’s claim is excluded from the respondents’ farm insurance policy because she was an in the named insured’s household”.“insured”, defined to include a relative while “living in the named insured’s household”.
[3] The application judge found that seven or eight years before her injury, Naomi had been driven from the family home at age 15 as a result of conflict with her mother,serious religious and lifestyle differences with both parents and her disclosure of five years of sexual exploitation by her father. She had lived a peripatetic existence away
[4] The application judge found that the term “household” signified more than a transient visitor. He found that at the time of her injury, Naomi shared no unity of purpose with her family and that she was merely a short-term visitor and not living in her parents’ “household”
[5] We see no error on the part of the application judge. In the context of this case and this policy, the application judge’s reference to the definition of “you” and “your”the part of the policy dealing with first party liability had no practical bearing on the proper interpretation of the phrase “living in the named insured’s household”.

Winter Driving Tips
Winter driving can sometimes be a daunting task, especially when conditions are snowy or icy. Follow these steps to keep yourself safe and collision free during the next few blustery winter months.
Step 1: Make sure that your vehicle is prepared for winter driving.
- Winter tires are a good option, as they will provide greater traction under snowy or icy conditions.
- Keep a snow brush/scraper in your car, along with possible emergency items such as a lightweight shovel, battery jumper cables, and a flashlight.
- Make sure that mirrors, all windows, and the top of your vehicle, are free of snow or frost before getting onto the road.
Step 2: Drive smoothly and slowly
- Don’t make any abrupt turns or stops when driving. Doing so will often cause your vehicle to lose control and skid.
- Driving too quickly is the main cause of winter collisions. Be sure to drive slowly and carefully on snow and ice covered roads.
Step 3: Don’t tailgate.
- Tailgating becomes much worse in winter weather. Stopping takes much longer on snowy and icy roads than on dry pavement, so be sure to leave enough room between your vehicle and the one in front of you.
Step 4: Brake before making turns.
- Brake slowly to reduce speed before entering turns. Once you have rounded the corner you can accelerate again.
Step 5: Learn how to control skids.
- When skidding, you actually need to go against your natural instincts and turn into the skid and accelerate. Doing so transfers your vehicle’s weight from the front to the rear and often helps vehicles to regain control.
Step 6: Lights On.
- Turn on your lights to increase your visibility to other motorists.
Step 7: No Cruise Control.
- Never use cruise control if conditions are snowy, icy, or wet, because if your car hydroplanes, your car will try to accelerate and you may lose control of your vehicle.
Step 8: Don’t “pump” the brakes.
- If your vehicle is equipped with an anti-lock breaking system (ABS), do not “pump” the brakes. Apply constant pressure and let the system do its work.
Step 9: Pay attention.
- Manoeuvres are more difficult to make in the snow. Be sure to anticipate what your next move is going to be to give yourself lots of room for turns and stopping.

Ottawa emergency crews responded to the call at 12:40 p.m. The driver of the other vehicle, a 50-year-old woman, was taken to an Ottawa hospital in stable condition with a fractured ankle. Thankfully, the man’s personal injuries are not life-threatening. There were no passengers in either vehicle. The cause of the collision is under investigation. The symptoms of a head injury can occur immediately or develop slowly over several hours or days. Even if the skull is not fractured, the brain can bang against the inside of the skull and be bruised. The head may look fine, but complications could result from bleeding or swelling inside the skull.
When encountering a person who just had a head injury, try to find out what happened. If he or she cannot tell you, look for clues and ask witnesses. In any serious head trauma, always assume the spinal cord is also injured.

- Slurred speech or blurred vision
- Stiff neck or vomiting
- Symptoms improve, and then suddenly get worse (change in consciousness)

I’m happy to see the community rallying around this family, as this is only the beginning of the love and support they will need. Friends and family of Leo Paul and Sherrianne Regnier said goodbye Monday morning to the couple killed after being struck by an out-of-control car while they were waiting for a bus on Albert Street. The poignant and intimate gathering at the M. John Sullivan funeral home in Cornwall included the couple’s three daughters, Serah, 15, Jessica, 13, and Isabella, 9.
Jessica spent time moving about the room before the eulogies, giving hugs to family and close friends, and managing to smile despite it all.
A little later on, Isabella playfully chased a smaller boy in a Toronto Maple Leafs jersey, giggling along with him.
Serah came in soon after and talked in a circle of loved ones.
Wearing a black leather jacket and dark jeans with a guitar case slung across her back, she sang and played three songs on an acoustic guitar for the crowd of mourners, including one she had written just the day before. Jessica, wearing a black dress, sat next to her. Their father, Leo Paul — known to everyone simply as Paul — was an avid music lover. Family and close friends gathered in a semi-circle around Serah and clapped at the end of each song. When she was finished and Serah said thanks, one woman said: “Your parents, they must be so proud of you.”
An estimated 200 people — including a large group of Leo Paul’s Transport Canada colleagues from Ottawa — packed the large reception room. One wall was completely covered by bouquets of fragrant flowers from family, businesses, health care centres and more.
Perhaps the most poignant was the arrangement in a place of honour next to photos of Leo Paul and Sherrianne: a large guitar made of flowers with an elegant ribbon that said, simply, “Brother.”Two eulogies were given, the first written by Sherrianne’s brother, Paul Depatie, but read aloud by a friend as Depatie was too emotional to speak, and the second from Bob Lacelle, one of Leo Paul’s many siblings.Guests moved to the front of the room to hear the two men, who stood in front of a glass and wooden case containing the two gold-coloured urns bearing the couple’s names.
Paul Depatie remembered meeting Leo Paul for the first time when he was 12 years old. He told the crowd they quickly struck up a meaningful friendship that did nothing but grow over time. He remembered growing up with Sherrianne, how she would “put me in my place” after he playfully tormented her.
And he remembered a pair of people devoted to one another, and to their daughters.
Lacelle spoke about “the sound of their souls’ music,” and about the “greatest gifts” they left behind them: Serah, Jessica and Isabella.
He also spoke of the need to protect the girls, to help them, to stay close.
“Our doors will never be closed to them,” he said. “Our hearts will always be open to them.”
It was quiet as he said his final goodbyes, for himself, for everyone present. Stifled crying growing louder, sniffling and the occasional cough from a child were the only things to be heard, aside from the low, sombre, slow and meaningful tone of Lacelle’s voice.
Following the eulogies and amid crying growing louder still, the pallbearers then led the immediate family out of the room, carrying the urns to a waiting hearse. The hearse led a funeral procession followed by a half-dozen motorcyclists in their jean and leather jackets, many of them from the Ironworkers Local 736 and including Leo Paul’s brother, Ronald Lacelle. The motorcyclists were followed first by the family and then by other guests, with the children in separate cars, to the internment at Notre Dame Cemetery.

Dr. Donald Chow’s condition was upgraded from critical to serious, a hospital spokesperson said. Chow, 53, was driving his motorcycle on Fisher Avenue in Ottawa last Saturday just before 3 p.m., when he collided with a car at the intersection with Kintyre Private. Chow suffered severe head and chest injuries, paramedics said. The elderly woman driving the car was transported to hospital with minor injuries, paramedics said. Chow, known as “Doc Chow,” has been with the Senators since 1992, said a media statement on the NHL team’s website. “He’s a very caring person. He’s helped every one of us in one way or another,” general manager Bryan Murray said.

Dr. Donald Chow, an orthopedic surgeon who works with the Ottawa Senators, suffered serious critical personal injuries in a car accident on his motorcycle in Ottawa Saturday. OTTAWA — A team doctor with the Ottawa Senators was still in critical condition in hospital Monday morning after his motorcycle collided with a car Saturday afternoon. Dr. Donald Chow, 53, was riding his motorcycle northbound on Fisher Avenue near Kintyre Private just before 3 p.m. Saturday, when a car pulled out in front of him. Chow was thrown from his motorcycle when it slammed into the side of the car, according to police. He suffered serious head and chest injuries. The woman driving the car was transported to hospital with minor injuries. Her car was seriously damaged . Police could not say whether charges will be laid.
People who saw the scene after the crash described the car as being “all dented,” with two shattered windows. The car had come to a stop on the southwest corner of Fisher Avenue and Kyntire Private, and Chow landed on the northwest corner.
Allison Neill, director of public affairs at the Ottawa Hospital, confirmed Monday morning that Chow remains in critical condition at the Civic Campus of the Ottawa Hospital. Chow has been with the Senators since their NHL debut in the 1992-1993 season. He is one of six team doctors who work with the team.
“The entire Senators family wishes Dr. Chow a full recovery and our thoughts and support are with him and his family,” said a statement from the Senators hockey club, issued Sunday afternoon. Members of the team respected the wishes of Chow’s family and did not provide comment to media Sunday night. Who is entitled to Ontario Accident Benefits? Ontario Accident benefits are available to people suffering from personal injury in a motor vehicle accident in Ontario. Often after being discharged from an Ottawa rehabilitation centre, (The Ottawa Rehabilitation Centre, The Ottawa Hospital-Civic Campus or Elizabeth Bruyere, in Eastern Ontario) , people with personal injuries will return to their homes only to find that their home needs modifications and their home cannot accommodate them. The Statutory Accident Benefits Schedule (SABS) is available to motor vehicle (car accident, boating accident etc.. victims in Ontario to help with these modifications.
Accident Benefits Schedule: Typically, Ontario car accident victims can receive accident benefits. Normally, these accident benefits are covered by the injured person’s own insurance company. However, accident benefits also provide coverage for people who do not have their own insurance. Typically, statutory accident benefits are there to replace lost wages, attendant care benefits, rehabilitation and medical benefits as well as wrongful death benefits.
Housing: The insurance company must pay the injured person for all reasonable and necessary home modifications and home devices, including communication aids. Ontario’s statutory accident benefits permits an injured person to buy or renovate a new home to meet his or her needs where that is the option that makes more sense than renovating an existing house. Having said that, the money alloted for the purchase of a home cannot be greater than the estimated cost of any renovations that would be needed to meet the injured victims needs.
The medical and rehabilitation benefits are supposed to pay for all reasonable and necessary expenses that arise because of the accident. Home modification comes under the medical / rehabilitation category.
After September 2010, this information will change. For now, if the injured person did not suffer a “catastrophic impairment” as that is described in the Accident Benefit regime, the total amount of the medical / rehabilitation benefit is $100,000 and the benefits expire after 10 years from the date of the accident. If the injured person did suffer a “catastrophic impairment” the medical / rehabilitation benefit increases to $1 Million and last for the duration of the victim’s life.
Timelines: It is important you notify your insurance company that you have had an Ontario accident within 7 days of the Ontario accident, or as soon as possible, and you must complete your application for Accident Benefits within 30 days of the Ontario accident.
What is an assessment? The assessments give suggestions to assist a person who is injured how to live safely and comfortably in their home if possible. The assessment focuses on returning the person who is injured to a level of function that approaches his or her pre-accident state to the extent that that can be done safely.
People who suffer a catastrophic injury may also need additional assessments . The assessments will result in a report. After the report is written, another form called a “OCF 18: Treatment Plan” will be submitted to the insurance company, outlining the proposed cost of the recommendations in the report. If the OCF 18 is approved, the work can begin.
Are home modifications limited to catastrophic injuries? Sometimes. Where the injured person has suffered personal injury that cause impairment but are on the less serious end of the spectrum, and if the renovations are not going to be extensive, an occupational therapist can perform a home assessment.
An assessment of the activities of daily living of the injured person is included in a home assessment. This assessment looks at personal care, housekeeping, home maintenance and care giving tasks. The report written by the occupational therapist will outline a list of any assistive devices and changes required to the home. For example: a railing, raising or lowering a bed or counter or adding hip-level storage in a kitchen.
If the recommended renovations included in the report are complete, it is submitted to the insurance company together with a Treatment Plan costing the recommendations to the insurance company for approval. If a person has serious personal injury and needs significant home modifications like ramps, additions, elevators, walls moved, a home accessibility report is required.
