Ottawa personal injury lawyer cautioning all Ontario distracted drivers.

Ottawa Personal Injury Lawyer David Hollingsworth… Ontario Provincial Police have a new focus:  distracted drivers. The OPP are going to crack down on people driving who are doing almost anything other than driving. Yes, that’s right. What does that mean? It could be cell phone or texting, fiddling with the radio in the car, eating and drinking, smoking, dealing with children. Anything that distracts drivers from the road.  I can honestly say as an Ottawa personal injury lawyer, there are far too many accidents as a result of distracted driving. 2012 has just begun and already we have 8 people who have been killed on Ontario highways due to distracted driving.

I know we are all in a rush but please put the phone away.  Don’t even keep it within arms reach when driving.  That way you won’t be tempted to answer it. Return your calls/texts when you arrive SAFELY at your destination.  Before cell phones, people managed and so can we.

Please drive safely out there !                                    -Ottawa Personal Injury Lawyer David Hollingsworth

What does a personal injury lawyer do ?

What does a personal injury lawyer do?

I am asked this question every day. The truth is a personal injury lawyer plays a vital role in ensuring you get what you need after an accident.  Often times, insurance companies will try to work with you but keep in mind they are not working for you.  They are not representing you.  A personal injury lawyer knows what to expect from the insurance adjusters.  Most times, they will have had or seen a similar case and know exactly what to expect.  After all, this is what a personal injury lawyer does day in, day out. Most times, an accident victim will contact a personal injury lawyer and that allows the lawyer to take over and represent you.  They then start ordering the necessary reports needed to build your case and they make sure that you are getting the support you need to start to recover.  This support comes in many forms. It may be rehabilitation support, medical support, housekeeping, counselling, home modifications, etc…First things first, a personal injury lawyer will meet with you to determine what your needs are and then start working for you to fulfill these needs. After an accident, everything seems different.  The beginning is especially hard because it’s a new way of life.  I meet everyday with Ontario accident victims who are struggling to get back the life they once had before the accident. Accidents are terrible and unfortunately they will continue to happen.  Personal injury lawyers can help.  They can help rebuild lives not only of the accident victims, but also their families. Yes, accidents affect everyone and it’s important that everyone involved gets the support they need. Each case is unique and everyone will have different needs.  The important thing is that accident victims get the help and compensation they need.  A personal injury lawyer can help with that.

If you have been in an accident or a family member or loved one has been in an accident, you should consult a personal injury lawyer .  They can help and they will.  You have been through enough.

Ottawa Personal Injury Lawyer David Hollingsworth:What are income replacement benefits ( IRB ) ?

Ottawa Personal Injury Lawyer David Hollingsworth, Ontario Injury Lawyers, Income Replacement Benefits..Often times  after suffering a personal injury in a  motor vehicle accident you may not be able to return to work right away. You also may not be able to provide for yourself and your family. Depending on the severity of your personal injuries, you may not be able to work for a few days, maybe a few months or perhaps even longer.  This is very stressful and this is where income replacement benefits comes in.

What are Income Replacement Benefits?

Income Replacement benefits are available to Ontario personal injury victims who were employed or self employed at the time of the motor vehicle accident in Ontario  and who, as a result of the personal injuries sustained in the Ontario accident, “suffer a substantial inability to perform the essential tasks of their employment”. This is the definition that applies for the first 2 years following a car accident in Ontario.

Following 2 years after an Ontario accident, it changes and becomes much more difficult to qualify for income replacement benefits. To continue to qualify for income replacement benefits, Ontario accident victims must  have “a complete inability to engage in any employment or self-employment for which they are reasonably suited by education, training or experience.”

How much do Ontario accident victims get for Income Replacement Benefits?

The amount of income replacement benefits received depends on a number of different factors such as one’s income before the accident.  As well as whether or not you opted to purchase additional accident benefits.

  • For motor vehicle accidents occurring after September 1, 2010, the amount of the weekly income replacement benefits is based on 70% of your gross weekly income before the accident, subject to the maximum amounts.
  • Under the standard accident benefits limits, the maximum weekly amount payable for the first 2 years following the accident in Ontario is $400 per week
  • No income replacement benefits are payable in the first 7 days following an Ontario accident
  • Optional accident benefits limits increase the maximum weekly amount to $600, $800 or $1,000 per week

How to apply for income replacement benefits…

In order to receive income replacement benefits,  Ontario accident victims  need to submit a completed

  • Application for Accident Benefits.
    •  OCF-10  Election of Income Replacement, Non-Earner or Caregiver Benefit
    • OCF-3 Disability Certificate
    • OCF-2 Employer’s Confirmation

If you have been involved in an Ontario car accident and are unable to work, you most likely qualify for income replacement benefits. It is important that before you fill out the associated accident benefits forms that you contact an experienced Ontario personal injury lawyer .  The best Ontario personal injury lawyers not only will help you fill out these forms, they will ensure that it is done in a manner that  gets you maximum benefits support.

    Ottawa Injury Lawyer David Hollingsworth…

Ontario, Ottawa Pedestrian Injury Lawyer David Hollingsworth. Ottawa Car Accident Lawyer David Hollingsworth on Ottawa car accident statistics.

Ottawa Car Accident Statistics. Sadly, there was a significant spike in fatal Ottawa accidents in 2011 with 38 people dying on Ottawa’s roads.   The number of life-threatening personal injuries dropped in 2010. Since 2006, the number of life threatening personal injuries has dropped every year. The Safer Ottawa Roads Program report indicates that the injury trend  is probably the more significant when it comes to measuring the safety of Ottawa’s roads. There’s a fine line between dying in a road accident and being seriously injury.  The report also measured the death and injury rates per 1,000 people. It showed clearly that Ottawa roads were much more dangerous back in the 1990s.  The report also breaks down personal injury and deaths from 2003 to 2010 by whether people were cycling, walking, or riding or driving in a vehicle. In both cases, slightly more than 7 /10 victims were motorists or passengers, 2/10 were pedestrians, and slightly less than 5/10 were cyclists. Let’s  do everything we can do decrease the number of Ottawa car accidents and personal injuries and death resulting from car accidents.
