Changes to Ontario Accident Benefits and the Minor Injury Guideline.

Personal Injury Lawyer Ottawa, David Hollingsworth…The Financial Services Commission of Ontario has again made some changes to Ontario accident benefits and unfortunately, in my opinion as an Ottawa personal injury lawyer, these changes do not favour Ontario drivers, should they become injured in an accident and need to access their accident benefits.  One of the  recent changes in accident benefits  has to do with the MIG (Minor Injury Guideline)  and it requires a pre-existing condition to have been included in a medical note by a health professional to get out of the Minor Injury Guideline.

As of February 1, 2014, the Government of Ontario has decided that Ontario drivers who are accessing their accident benefits and who fall under the Minor Injury Guideline are limited to the cap of $3,500.00 UNLESS they have a  pre-existing medical condition and this pre-existing medical condition must have been documented by a health practitioner prior to the accident.  This is a new requirement. Before February 1, 2014,  pre-existing medical conditions did not need to be documented.  Essentially , what this means is that if you were injured before but had perhaps  not sought out medical treatment that was documented, then you will not be considered for the exclusion of minor injury guidelines and most likely your treatment will be limited to the $3,500.00 cap.

This change in accident benefits highlights why it is critical to treat any injury as serious. Most people think things will heal naturally over time and often can’t find the time to get to the hospital or doctor.  With wait times the way they are, it is understandable; however these types of changes highly why Ontario drivers need to make this a priority. Unfortunately, once an accident has occurred, you can’t turn back the clock.

If you have been in an accident and are injured, it is imperative you speak with an experienced personal injury lawyer.  It’s important you know your rights and leave no stone unturned in the event that weeks, months or years later your injuries prevent you from a quality of life you once had.  If you have a question or would like more information about the recent changes to Ontario Accident Benefits,  contact us at . We would be happy to sit down with you free of charge .

Completing OCF forms

Did you know that pedestrians have many rights and can be entitled to accident benefits if they are injured in an accident involving a motor vehicle?  If a pedestrian is injured and they have their own insurance policy, accident benefits can be obtained through their own insurance company. An injured pedestrian must notify their insurance company and request an Accident Benefits package.  The insurance company will then send out a package in the mail , which needs to be completed in a timely manner.  This package contains many OCF forms.  Our accident benefits specialists are available to complete these forms for you at no charge.  It’s important that all the required OCF forms be filled out and that there are no mistakes on your OCF forms.  It’s not that mistakes can’t be corrected, but they may delay the process or in extreme cases deny you of accident benefits to which you are entitled to.

Most of our personal injury clients prefer to let us complete all the OCF forms on their behalf. We can also do this for you.

Ottawa Injury Lawyer David Hollingsworth: How to prevent a slip and fall accident.

Slip and Fall Accident Lawyer

Good morning Ottawa ! It is cold out there today and very slippery. There is a layer of ice on the ground and its hard to see , as last night’s snow is covering the ground.  This is typically when slip and fall accidents happen. With the holidays here we are all out just a little more, shopping and visiting with others and often we are carrying bags or presents. This, coupled with our weather conditions contribute to a higher incidence of slip and fall accidents.  Slip and fall accidents  in Canada makeup more than 50% of all personal injuries . Slip and falls accidents are the primary cause of accidents in hotels, restaurants and public buildings such as shopping malls.

As a property owner, it’s also important that you keep your property as safe as possible. This means keeping your walkways and steps clear of ice.  Property owners have a “duty of care” to see that their property is reasonably safe.  This not only means ensuring steps and walkways are cleared away in a reasonable manner, it also means  your home doesn’t have structural defects, hazardous conditions have been addressed.

Yes, accidents do happen but many accidents are preventable. There are things you can do to lower your risk of a slip and fall accident such as watching for ice, wearing proper footwear, walking slowly, keeping your hands free in case you do fall.

Common Slip & Fall Injuries include:

Tragic Ottawa rollover accident Upper Dwyer Hill at March road: car submerged in water filled ditch.

Car Accident Upper Dwyer Hill

Ottawa Personal Injury Lawyers David Hollingsworth. Sadly, a 43 year old woman died yesterday at an Ottawa hospital. She had been submerged under water car after her car  flipped and landed in a ditch filled with water on Upper Dwyer Hill Road at March Road. Emergency crews got the call around 8:15, but tragically Ottawa firefighters couldn’t help the woman. They had to first tow the car out of the water ditch and turn it over before Ottawa paramedics could try to start to save her .   She was air-lifted to an Ottawa hospital and sadly she succumbed to her injuries. My thoughts are with her family and friends at this very sad and difficult time.

Wrongful Death and Car Accidents

Our personal injury lawyers meet regularly with families who have lost a loved one in a car accident. We sit down with these grieving families and share with them what we can do to help.  Unfortunately, we can’t do what they want most , which is to bring their loved one back. Our injury lawyers can help in other ways. We can help secure death benefits so that loved ones receive a proper send off.  Also included in Ontario Accident Benefits are expenses paid by family members related to a funeral.  Our lawyers represent families at some of the most difficult times of their lives and help secure death compensation such as: Funeral Expenses up to $6,000.00, Spousal Death Benefits: $25,000.00 and Dependents’ Death Benefit: $10,000.00 each.  We understand that this is not enough.  In the case where someone else was negligent for the death of a loved one, you may have a wrongful death lawsuit you can also pursue.

In order for a death to be considered wrongful death lawsuit, it must establish that the death:

  • Was due to negligence or recklessness of another party.
  • Has caused measurable damages, for example a spouse is now suffering from financial issues as the deceased was  primary breadwinner.

Ottawa Lawyer: Sport Injuries and Compensation

Head Injury in Sports

Ottawa Personal Injury Lawyer David Hollingsworth

I receive calls regularly asking me questions about sporting injuries and does one have the right to sue. In every sport, there are injuries. While some injuries may be avoided in sports, others aren’t.  Sporting injuries can happen anywhere; a friend’s house,  school, gymnasiums, sport fields and sport training facilities. Football and hockey seem to be the sports with the highest rates of severe injuries that hear of due to the high impact and high number of head injuries associated with these 2 sports. Some sport head injuries become mild concussions and people are able to return to their sport within a few days or weeks. As we all know, there are also severe head, back, brain, neck and spinal cord injuries that result from sporting accidents.  These injuries are life-altering and catastrophic injuries.

I’m often asked about compensation about such injuries.  Not all cases of sporting injuries result in the right to sue and seek insurance compensation. In order to receive compensation, it needs to be proven that the  facility where the injury took place provided  unsafe, or dysfunctional equipment. If this is proven, then they can be help liable. It may be difficult to prove negligence , but with proper documentation, pictures and witnesses , a personal injury lawyer can help build a personal injury case to ensure you receive maximum compensation.
