How to prevent motorcycle accidents..Ottawa lawyer David Hollingsworth

Ottawa Ontario Personal Injury Lawyer…www.ottawainjury.ca  It’s that time of year again when we will start seeing more and more motorcycles on our Ontario roads. Motorcycle drivers are much less protected on their vehicles and therefore need to take all safety steps possible to prevent accidents and personal injury. As well, all drivers need to be aware that we share our Ontario roads with motorcycles, bicycles and other vehicles.

Thankfully Transport Canada has reported that the rate of deaths related to motor vehicle is slowly declining; however, the rate of motorcycle fatalities is on the rise. There are many possible reasons why this may be so.  There may be more motorcycles on the roads. Motorcycle riders between the ages of 45 to 54 are the most common ages amongst motorcycle drivers.

Ontario motorcycle helmet use has improved. Unfortunately3.1 % of motorcycle riders still drive their motorcycles without one. Head injuries are still the leading cause of deaths involving motorcycle accidents and motorcycle drivers without a helmet are 40% more likely to suffer a fatal head injury, and also 15% more likely to suffer serious personal injuries. A study that was previously done indicated that helmets saved 1,800 lives of motorcycle riders involved in accidents in 2007.

Please drive and ride safely  …

Chronic Fatigue Syndrome ?

Chronic Fatigue Syndrome (“CFS”) is a real disorder affecting hundreds of thousands of people in North America.  We have our fair share of chronic fatigue syndrome sufferers here in Ottawa as well. Often the syndrome can present itself to a victim after an accident or injury. The cause of chronic fatigue syndrome is not perfectly understood, though the World Health Organization classifies it as a Disease of the Nervous System. Secondary to an accident, clients will often describe to their injury lawyer levels of fatigue they are experiencing. It is important for a person to also consult with their medical team to ensure that they are receiving the best attention possible to ensure for the best possible health. Your injury lawyer can help you with your recovery to ensure that you do not lose out on what accident benefits you may be rightfully entitled to.  The classification of CFS will involve several factors. Notably, a classification of CFS will entail (1) ruling out other conditions that you may suffer from and (2) it must be shown to be otherwise unexplained, relapsing fatigue that is new (i.e. you have not had this condition all your life, it is not predated fatigue); (3) that the fatigue is not the result of ongoing exertion; (4) that the fatigue is not relieved by rest; (5) and that the condition results in substantial decreases in your levels of occupational, social, educational, or personal activities.

Furthermore, to prove Chronic Fatigue Syndrome,  the patient must exhibit at least four of the following enumerated symptoms, which must persist for at least six months: (1) Difficulty with memory or concentration; (2) Sore throat; (3) Tender cervical (neck area) or axillary (underarm area) nodes; (4) Sleeping but not feeling rested; (5) Arthralgias (pain along the nerve of the joint) – no redness or swelling; (6) Headaches; (7) Muscle pain; (8) Post-exertional malaise, lasting more than one day. Our Ottawa injury lawyers work closely with medical professionals who specialize in chronic fatigue syndrome. We understand how difficult life can be living with this syndrome and are here to help.

Avoid an accident and personal injury- watch out for black ice.

Ottawa injury lawyer on how to avoid Ottawa accidents and black ice. icyroads

It’s the last day of March break and it’s awfully cold out there today.  I’m just about to go out and hit the slopes with my son.  I’ve been skiing for a couple of days now and I’m sore and stiff !  Regardless, my son is excited, so off we go ! I hope my muscles forgive me someday.  Although it’s sunny out there..there is still a chill and with that comes black ice.

There are too many injuries in Ottawa each year due to black ice. Generally, drivers are caught unprepared. Black ice, sometimes known as “glare ice” or “clear ice” is deadly because it is difficult to see – it can sneak up on you when you least suspect. Ottawa Personal Injury lawyer David Hollingsworth shares his thoughts on how you can drive safely through the Winter season and practice safe driving habits.

Each year, there are an incredible number of Ottawa automobile accidents due to the ice conditions here in Ottawa and in Eastern Ontario. The goal is to establish safe driving habits that will protect you when you drive during black-ice season. As a preliminary, always strive to stay alert – this means that since black ice can be anywhere, it is wise to remember driving carefully, with all attention on your surroundings.

More specifically, you can stay tuned to weather and news reports that will advise drivers on particularly bad days and intersections that require careful attention. Black ice is not truly black, though it is virtually invisible to the driver’s eye, so sharp turns, and busy intersections, for example, will require extra caution to safeguard your safety and well-being. “Most accident victims don’t notice the black ice on the road until it is way too late,” says Ottawa personal injury lawyer David Hollingsworth. “You have to automatically assume that if there is a slight chill in the air, there will likely be ice, SO please… slow down and avoid car accidents.”

Ottawa lawyer shares tips to avoid slip and fall accident and injuries.

Ottawa based injury lawyer David Hollingsworth, shares his recommendations for the winter and Slip and Fall Injuries.

A slip and fall accident can happen anytime, any season. We had such an incredibly warm gorgeous day today. Unfortunately they are calling for a flash freeze tonight in Ottawa.  With all the snow that melted today, we will surely be seeing more ice tomorrow.  I posted this post over a year ago and thought Id share it again… Please ensure to watch your step out there tomorrow ! Many often forget to fully consider the potential for personal injury and the associated ramifications of pain and suffering. Even a minor slip can lead you to much stress and tension on you and your loved ones. A slip and fall injury can result in massive medical bills, loss of work, lost wages and more. If a slip and fall injury happens to you, an Ottawa personal injury lawyer can explain to you what your rights are and make sure your interests are protected.

How to Protect Yourself and Your Family from a slip and fall accident :family

I deal with a tremendous number and variety of slip and fall accidents on a regular basis each year. Such slip and fall injuries can happen at any time of the year, and in any location or setting. However, there are certain conditions that render the possibility of injury more likely, so please on to learn how to protect you and your family from the prospect of injury, and to learn what to do in the event that you are injured by a slip and fall injury.

There are certain circumstances where the city of Ottawa may be responsible for your slip and fall accident. For example, imagine you are walking down the street at night. As you try to cross the street, you approach an open man-hole (the city has neglected to put the cover back after working on the sewer system earlier in the evening). Naturally given the lack of light, you do not see the open manhole and fall right through, experiencing broken bones, fractures, and lacerations. Perhaps your personal injuries are more psychological in nature.

Who is Responsible in a slip and fall accident?

The city of Ottawa would be responsible (through the action of one of it’s employees) for their negligence and your injuries. There are many other instances where slip and fall injuries could occur, such as (1) flooring/carpeting in poor repair (2) parking lot surfaces in poor repair (3) ice and snow buildup (4) elevators/escalators/stairways (5) areas with poor lighting, (6) and so on.

Compensation for slip and fall accidents :

Depending on the circumstances of injury, your recovery could include compensation to help with stress and tension, medical bills, lost wages, and so on. A good Ottawa personal injury lawyer can give you an idea of what you may be entitled to. Business and property owners have a legal responsibility to ensure that people on their establishment or property are safe and not at risk of suffering an injury. If an accident has happened to you, it may be due to the negligence of a property owner who has failed to act according to their due diligence responsibilities to keep you and your family and loved ones safe.

If your slip and fall accident happened in the Ottawa or the Eastern Ontario area because a property owner failed to keep you safe, David Hollingsworth, experienced Ottawa personal injury lawyers can help you recover the costs of your medical bills, lost wages, and awards for pain and suffering. With his knowledge and extensive experience, he is the Ottawa personal injury lawyer that can help get the maximum possible awards for slip and fall injury victims and help them recover as best as possible.

Ontario car accidents and baby car seat installation tips, Ottawa Lawyer

What you need to know about car seat installation childinjury

As a father of three young children who are all still in car seats, I found it  astonishing that 84 % of baby and infant car seats are not  properly installed. Proper car seat is crucial.  Improper car seat installation  leaves our children unsafe in the event of a car accident and more likely to suffer serious personal injury. It’s important to ensure your child is properly secured in their car seat to keep them safe. The following are a couple of things you can do help ensure your child’s safety in the event of a car accident:

Don’t buy a used car seat. A used car seat may have missing parts or was involved in a previous car accident. Older car seats also expire in 6-9 years. If you do however purchase a used car seat, please call the manufacturer to verify if it is still safe. Here are a few things you can do to help ensure your child’s safety.

  1. 45 degree angle: Put rear-facing car seats at a 45-degree angle. At this angle, the baby’s head is supported and its chin won’t fall to the check, blocking your baby’s airway.
  2. Snap then Wrap: Cover your baby with blankets or dress him or her warmly if it is cold outside. But, beware bulky snowsuits will be compressed in a car crashor car accident, and the baby could be ejected from the car if the harness becomes loose. Dressing the baby warmly, and buckling in, then covering the baby with blankets for warmth is safer.
  3. Center Up: The best, safest location for your baby’s car seat is in the center seat. If you have multiple children, any back seat spot is safer than the front.
  4. Double Check: Use free installation checks performed by certified technicians, such as local Ottawa fire  stations or the Ottawa police.

And of course, ALWAYS drive safely !
