Ontario Accident Benefits Insurance Compensation. Which optional benefits should you purchase?

Ontario Accident Benefits Insurance Claims David Hollingsworth Personal Injury Lawyers.   The Ontario insurance regime is one of the most complicated insurance regimes in North America. When it comes to car insurance, you certainly don’t want to scrimp but you always don’t want to pay extra money if it’s not needed. Sadly, when it comes to choosing optional accident benefits, many people will automatically settle for basic coverage.  As an Ottawa personal injury lawyer, I can tell you, this may be a huge mistake.

Now, the truth is hopefully you will never need to access your accident benefits .  Great !  If you do however get injured in an accident, you may find yourself unable to work, injured, in a home that needs modifications and that’s when you want to make sure you have access to as much accident benefits compensation as possible. Sadly, most people don’t really know what their accident benefits insurance coverage is until they really need it.

A basic auto insurance policy in Ontario contains far less accident benefits coverage than a policy where the “top-ups” have been purchased.  Along with this decrease in benefits comes a decrease in yearly premium payments.  Many will opt for this.   I would caution you not to. I urge everyone to speak with their broker and find out what optional benefits are available to you and at what cost.

For instance the  Medical and  Rehabilitation Benefits jump from $100,000 to $50,000 or possible even $ 3,500 if you have purchased the optional benefit.

If you purchase additional accident benefits, you can be entitled to  Housekeeping Benefits and Caregiver Benefits , which have been eliminated in the basic policy.

Attendant Care Benefits are another optional benefits that can be purchased and allow you to have access to $72,000 instead of  $36,000. You may have access to additional accident benefits through your work and in this case may not require purchasing additional accident benefits.

It’s important to know what options you have and choose what’s best for you and your family.  Another important piece of information you need to know is that if you have more than one vehicle, you only need to purchase these additional accident benefits for one vehicle only.

In my opinion, the top up amounts are well worth it.  An average vehicle can purchase most additional accident benefits for under $200 a year.  That $200 a year translates to a significant amount of money if you need, when you really need it. I cannot tell you how many personal injury cases I have settled where people have given additional much need funds and they are so thankful that they purchased those additional accident benefits. Talk to your broker about what options you have and what accident benefits are available to you. Who pays for Ontario accident benefits insurance compensation?

Since Ontario has no-fault insurance, it can be confusing and sometimes difficult to understand who exactly pays for insurance compensation.  Does it come directly from the driver’s pocket? The other driver’s pocket? Your own insurance company? The other driver’s insurance company? Regardless of who is at fault, if you are seriously injured, you are entitled to certain Ontario accident benefits from your own car insurance company or from the car insurance company of another vehicle involved in the accident, no matter who is at fault. Depending on the circumstances of your accident, Ontario accident benefits compensation can come from any of the following.

  1. your insurance company
  2. the insurance company of the vehicle that you were travelling in as a  passenger
  3. the insurance  company of the any vehicles involved in the accident .
  4. if uninsured, the MVAC:  Motor Vehicle Accident Claims Fund . This is a fund established by the Government of Ontario to help compensate people who need help but have no insurance at the time of their accident.

Ottawa accident highway 401 and highway 416 sends 2 to hospital with hip injury, pelvis injury, shoulder injury and severe leg fracture.

Brockville Accident

Accident highway 401

An accident on Highway 401, east of Brockville Friday resulted in a 20 car pileup accident and left  two people with serious personal injuries. The accident occurred close to Maitland and the  416  split. Although the snow storm only lasted 5 minutes, it caused a lot of damage and injury.  Cars and tractor trailers were swerving all over the highway and one tractor trailer caught flames. Given the number of vehicles involved in the accident, it’s no wonder there were not more injuries. Ottawa paramedics reported that a 68 year old woman suffered a hip injury, pelvis injury and shoulder injuries.  They also reported that a 33 year old man suffered a fractured leg.

Thankfully many drivers were able to pullover to safety as the intense snow storm began.  There is no doubt that this helped in keeping the number of injured down to 2. The Ottawa Police and the Ontario Provincial Police are investigating the accident. I am so thankful no one died and I hope that the 2 people who did suffer personal injury are able to recover fully from this terrible accident.

Our personal injury lawyers travel to Brockville on a regular basis to help people who have been injured or lost a loved on in a Brockville accident. How you can receive housekeeping and home maintenance expenses after an Ontario accident.

What are housekeeping benefits ?

Taking care of your home seems like the last thing you need to think about after an accident but unfortunately, you need to or you need someone helping  you. If your accident was in Ontario, you may be eligible for Ontario accident benefits from your insurance company or the insurance company of the driver who was at fault. There are several different accident benefits available to you. One involves housekeeping and home maintenance expenses. Basically, if you are unable to perform your usual housekeeping duties or home maintenance duties, your accident benefits can cover someone performing these duties for you.

How much are housekeeping benefits in Ontario ?

The maximum housekeeping and home maintenance benefit payment is $100 each week.

Does everyone qualify for housekeeping benefits?

This home maintenance and housekeeping benefit  is available only to Ontario accident victims who are deemed  “catastrophically injured” in an Ontario accident. However, the FSCO -Financial Services Committee of Ontario has made housekeeping and home maintenance benefits available to non-catastrophically injured accident victims as well by purchasing additional accident benefits. Yes, this means an additional cost each month to an already expensive insurance payment.

Should you purchase additional accident benefits?

We understand that purchasing these additional accident benefits may not seem to make sense; however,in the event of an accident , you may rely heavily on your insurance benefits.  If you are unsure of whether or not you have access to these Ontario accident benefits, let us know and we can help steer you in the right direction.  We can give you advice and let you decide how you want to approach your insurance company. Eastern Ontario highway accidents increase in 2012. Ottawa lawyer David Hollingsworth

Accidents resulting in death

Statistics reported in the Ottawa Citizen today revealed that there were many highway accidents that resulted in deaths in Eastern Ontario in 2012. The highways that are under the Ontario Provincial Police’s watch went up by close to 1/3  last year, compared to 2011.  Accidents killed 73 people in the eastern Ontario area compared to 55 in 2011.  Last year was the highest rate of accident deaths since 2008.

Drinking and driving  was the cause of 9 deaths and improper seat belt use caused 16 deaths, That’s 25 AVOIDABLE deaths !  Reckless driving , driving too fast and not paying attention also contributed to many eastern Ontario accidents.

Our Ottawa personal injury lawyers work closely with families who have lost a loved one in an accident and are devastated.  Families would do anything to bring their loved one back to life and no amount of compensation can do that for them.  Ontario accident benefits pay for funeral expenses and loss of income etc, but can never replace a loved one.

Please be aware of your surroundings when driving.  If you are unsure of the roads, slow down and be extra cautious. Avoid distractions including loud music, devices that are not hands free etc.. We also need to remind our new young drivers about being responsible drivers and the best way to do so is by setting the best possible example we can as drivers.  I challenge each and every one of you to be the best driver you can possibly be, lower accident statistic and save lives. Thank you.

Compensation for wrongful death

If you have lost a loved one in an accident; we are sorry. Our personal injury lawyers can help get accident benefits for wrongful death. We are free to meet with you and walk you through your options and what benefits and compensation you are entitled to.  You have been though enough, let us help.

Ottawa pedestrian accident Kent street results in head injury, pelvis injury and arm injury.

Ottawa Pedestrian Accident

An unidentified 50-year-old woman was rushed to an Ottawa hospital with serious personal injuries after she was hit by a truck on Kent street, near Slater this  morning at approximately 7:30. The impact caused her to suffer personal injuries to her head, pelvis, and arm.  I wish her a full recovery and hope none of these injuries are permanent.

Pedestrian accident often result in serious injuries and many pedestrians are unaware of the accident benefits they are entitled to. Regardless of whether or not a pedestrians has their own insurance policy or regardless of whether or not they are at fault, you have rights and you likely have an injury claim for compensation against the driver of the vehicle that hit you. Most pedestrian are entitled to medical expenses, medical treatments. and compensation for pain and suffering among other expenses.

The question that comes into play in a pedestrian accident is ..was there contributory negligence.  Contributory negligence is when the pedestrian is help party responsible  for the accident. The amount of compensation is reduced if the pedestrian is found partially responsible for the accident.  In other words, the insurance company will try to pay less in compensation if the pedestrian was not crossing at a crosswalk etc… This is when it is absolutely vital that you have an experienced personal injury lawyer representing you.  not only will your personal injury lawyer protect you and your rights, they will ensure that the proper amount of compensation is paid out and not a reduced amount based on factors the insurance company is going to try to argue.

Pedestrian accident claims can be tricky and it’s important that you hire a personal injury lawyer you are comfortable with and can trust. Request a free consultation with a lawyer and ask them point blank what experience they have with pedestrian accidents and what type of compensation, benefits and support you can expect.  If they know what they are talking about, you will know right away that they are the personal injury lawyer for your pedestrian accident.

Ottawa pedestrian car accidents

Ottawa accident Innes and Frank Kenney road results in serious leg, internal and head injury. Ottawa Lawyer David Hollingsworth shares..

Ottawa Accident Lawyer

Ottawa Injury Lawyer David Hollingsworth…

Sadly, a 28 year old pregnant woman is in very serious condition in and Ottawa hospital after an Ottawa accident yesterday, close to Innes and Frank Kenney roads. The woman was  8 months pregnant when she suffered serious personal injury, including internal injuries and a serious leg injury. Sadly, the 29 year old man driving the car also suffered a very serious head injury. He remains in serious but thankfully stable condition in an hospital at this time.  My thoughts go out to both of them at this very stressful time.

The leg injury seems the least serious of all these injuries ; however there are many  complications that can arise from a leg fracture such as:

  • Chronic leg pain,
  • Bone infections,
  • Nerve damage
  • Infections
  • Depression
  • Tissue damage
  • Decreased blood flow
  • Blood vessel damage
  • Length of leg changes
  • Severe Arthritis
  • Loss of mobility

A leg injury can be very painful and life-altering injury. Suddenly, with a leg injury you are not able to live the life you once had.  In some instances, even after a leg injury has healed there is decreased mobility and sometimes this decrease in mobility can be so severe that one is unable to return to work or the quality of life they once had.

This is where experienced personal injury lawyers can help with ensuring that maximum compensation and rehabilitation is put in place.

If you or a loved one has suffered a leg injury it’s important that get a medical diagnosis asap and the proper medical treatments .  These medical treatments will most likely get expensive over time and that’s when the importance of maximum compensation becomes clear.  An experienced personal injury lawyer will ensure you have enough compensation to live with for years and years to come , as your leg injury will likely be with you for years and years to come.  You owe it to yourself.
