Contingency Fees and Personal Injury Lawyers

Personal Injury Lawyer Ottawa David Hollingsworth and Associates.

Many people are involved in an accident and don’t know what to do. They don’t know their rights and they need advice. That’s where the best Ontario personal injury lawyers can help.  I have been an Ottawa personal injury lawyer since 1999.  I often meet or speak with people who have recently been injured in an accident. My goal is to provide them with as much information as possible so they can decide what to do.  In some cases, I can simply advise them as to how to deal with their insurance company. In other instances I can advise as to how a personal injury lawyer can help them achieve better results.  I like to meet with my clients and then give them their options. I do however offer more than free consultations.  I take most personal injury cases on a contingency fee basis, which means that I carry the costs throughout the lawsuit, meaning my clients do not have upfront fees or costs during the lawsuit and I am reimbursed when the case is successfully resolved. When we meet, we agree what payments will be made to me, when the cases settles successfully. This means that my clients do not have to worry about any bills or legal costs throughout the entire process.

Who Pays Disbursement Costs?

Disbursements are the out-of-pocket expenses that some personal injury lawyers carry for their clients while working  on the lawsuit. We are Ottawa personal injury lawyers who do not ask for any upfront disbursement money from our clients. In personal injury claims, disbursements  include various costs such as obtaining doctors’ records, hospital charts, expert witness fees, court filing fees and the costs of transcripts.

Contingency Fees

Contingency fee arrangements are typically the best method for most clients.  There is also  peace of mind knowing that you do not have to pay any costs  if you are not successful in your case.  My previous clients can attest to the fact that when their life gets turned upside down in an accident, the last thing they need to be worrying about are legal bills.  Thankfully, I get to help them get the money that they need and are entitled to.  I am fortunate that I am the guy that at the end of the day has been there throughout the process and get to give out large settlements, which allow my clients to begin to rebuild their lives after a traumatic event.

Ottawa Accident Lawyer: Tailgating Test..do you do it ?

Ottawa Accident Lawyer David Hollingsworth discusses what exactly is a tailgate accident…We all have places to go and we all want to get there as quickly as possible.  I understand .  Many Ottawa accidents occur as a result of tailgating. As an Ottawa injury lawyer, I am reminded too often of the dangers of tailgating.tailgaitaccident

Tailgate Accidents , did you know…

  • That following closely and tailgating is the cause of the majority of rear-end collision accidents – which also accounts for 1/3 of all Ottawa accidents.
  • Between 2005 and 2007, 13,333 Ottawa accidents occurred, which resulted in 4,237 personal injuries and 11 deaths.
  • Most Ottawa accidents occur during morning rush hour, between 8:00 and 9:00 AM, then slowly taper off. Increasing gradually to peak at evening rush hour (4:00 PM to 5:00 PM) then again taper off during evening hours.
  • 72% of Ottawa accidents occur in clear, dry weather. 12% occur during rain,  and another 12% during snow or winter conditions.
  • Approximately 1/2 of Ottawa accidents occur at an Ottawa intersection.
  • Car accidents account for the majority of fatal accidents.
  • Approximately 30% of personal injury related Ottawa accidents occur when a driver disobeyed a red light.

What is considered tailgate?

What is a safe distance to travel behind other vehicles to avoid an Ottawa accident? Apply the two-second rule. It is the same method that is outlined in the Ontario Ministry of Transportation’s Driver’s Handbook. Use this test while driving.

  • Choose an object ahead of you on the road to use as a reference point– EX: road sign, pole or tree
  • Once the back-end of the vehicle ahead of you passes the reference point, start counting using steamboats.
  • Count how long it takes the front of your vehicle to reach the same reference point.
  • If it takes less than two seconds (or steamboats), you’re travelling too close and are risking an Ottawa accident.
Important: In wet or slippery conditions, you should allow even more time. Allow yourself time to react and stop quickly and avoid an accident and serious personal injuries…. I came across this valuable information on the City of Ottawa’s website and thought I would share it with you. It make take a little extra time to get there, but avoiding an Ottawa accident and personal injuries….Please take your time and arrive safely…

Ottawa Slip and Fall Accident Lawyer David Hollingsworth

Although our snow seems to have disappeared this weekend, it will be back and it will be back with a slipandfallaccidentvengeance. One of the major hazards of living in Ontario is dealing with large amounts of snow and ice. Every winter, people living in Ontario and specifically Ottawa, receive a heavy dose of  winter white wonderland. While the sight of falling and accumulating snow can be pretty, a slip and fall accident on  snow or ice can be very painful and may have life and implications on your health.

Many people in Ontario and Ottawa don’t realize that landlords and homeowners have the responsibility of clearing snow and ice to prevent slip and fall injuries, as best as reasonably possible. If a person suffers from a slip and fall accident  while walking on snow or ice that should have been cleared, the injured victim can sue for damages associated with that slip and fall accident in Ontario.

With all of the dangers associated with winter walking, driving and travel during the winter in Ontario, it is important to know what to do after a slip and fall accident in Ontario.

What To Do After a Slip and Fall Accident in Ontario…

There are several steps that should be taken after an Ontario slip and fall accident.  Here is a brief overview:

Seek medical attention immediately: If the personal  injuries resulting from an Ontario slip and fall are serious, such as a brain injury or back injury and spinal cord injury, the victim should get immediate medical attention.

Note the scene of the accident: After a slip and fall accident where you have suffered serious personal injury, it is important to document the ground conditions. It is critical to remember whether the ground was snow covered, icy, uncleared or partially uncleared of snow, ice or other obstacles.

Gather evidence from the slip and fall accident: After a slip and fall accident in Ontario, gather evidence that include the slip and fall accident location , photos of the condition of the ground (use your phone), contact information of witnesses, such as names and phone numbers, and the landowner or homeowner where the Ontario slip and fall accident occurred.

Contact an experienced Ontario Slip and Fall Accident Lawyer

An Ottawa personal injury lawyer can help an injured victim gather the best evidence, prepare the file  and  investigate who is responsible for the medical costs, personal injuries and lost wages after an Ontario  slip and fall accident in Ottawa.

After a serious Ontario slip and fall accident resulting in personal injury, it may be difficult to remember these crucial steps. If you are unable to gather evidence and report the slip and fall accident yourself, you should contact an experienced personal injury lawyer asap and have them help you so you can focus on your recovery from your slip and fall accident and they can work on getting you maximum compensation for your personal injuries.  You have been through enough, let an experienced slip and fall injury lawyer help you…
